7 An Act relating to airport infrastructure; creating
7 the Oklahoma Southeastern Regional Airport
8 Improvement Revolving Fund; providing source of
8 funds; providing for expenditures; requiring certain
9 determination by the State Treasurer; setting certain
9 circumstances for reversion; making an appropriation;
10 providing for codification; providing an effective
10 date; and declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 416 of Title 3, unless there is
15
16 created a duplication in numbering, reads as follows:
16
17 There is hereby created in the State Treasury a revolving fund
17
18 for the Oklahoma Department of Aerospace and Aeronautics, to be
18
19 designated the "Oklahoma Southeastern Regional Airport Improvement
19
20 Revolving Fund". The fund shall be a continuing fund, not subject
20
21 to fiscal year limitations, and shall consist of all monies received
21
22 by the Oklahoma Department of Aerospace and Aeronautics from
22
23 appropriations of the Legislature designated for deposit in this
23
24 fund. All monies accruing to the credit of the fund are hereby

1 appropriated and shall be budgeted and expended to provide funding

2 for repairs, planning, staging, refurbishments, improvements to real
2
3 and personal property, and for an air traffic control tower at any
3
4 regional airport that is east of United States Highway 69, south of
4
5 United States Highway 70, and within an Oklahoma municipality with a
5
6 population of no more than twenty thousand (20,000) persons and no
6
7 less than ten thousand (10,000) persons as determined by the latest
7
8 Federal Decennial Census. No expenditures shall be made from the
8
9 fund until the State Treasurer determines that funds provided by
9
10 local and county governments, tribal governments, the federal
10
11 government, real and personal property donation, or through monetary
11
12 donations in the amount of Ten Million Dollars ($10,000,000.00) are
12
13 made for repairs, planning, staging, refurbishments, and
13
14 improvements to real and personal property, and for an air traffic
14
15 control tower at any regional airport that is east of United States
15
16 Highway 69, south of United States Highway 70, and within an
16
17 Oklahoma municipality with a population of no more than twenty
17
18 thousand (20,000) persons and no less than ten thousand (10,000)
18
19 persons as determined by the latest Federal Decennial Census;
19
20 provided, no funds collected or received prior to the effective date
20
21 of this act shall be counted toward the amount. Expenditures from
21
22 the fund shall be made upon warrants issued by the State Treasurer
22
23 against claims filed as prescribed by law with the Director of the
23
24 Office of Management and Enterprise Services for approval and

1 payment. On July 1, 2027, if no determination is made by the State
1
2 Treasurer pursuant to the provisions of this section authorizing
2
3 expenditures from this fund, all unencumbered funds remaining in the
3
4 Oklahoma Southeastern Regional Airport Improvement Revolving Fund
4
5 shall be transferred to the State Treasurer for deposit in the
5
6 General Revenue Fund of the State Treasury for the fiscal year
6
7 ending June 30, 2023.

8 SECTION 2. There is hereby appropriated to the Oklahoma
8
9 Southeastern Regional Airport Improvement Revolving Fund from any
9
10 monies not otherwise appropriated from the General Revenue Fund of
10
11 the State Treasury for the fiscal year ending June 30, 2023, the sum
11
12 of Ten Million Dollars ($10,000,000.00).
12
13 SECTION 3. This act shall become effective July 1, 2025.
13
14 SECTION 4. It being immediately necessary for the preservation
14
15 of the public peace, health or safety, an emergency is hereby
15
16 declared to exist, by reason whereof this act shall take effect and
16
17 be in full force from and after its passage and approval.
