7 An Act relating to the Oklahoma Floodplain Management
7 Act; amending 82 O.S. 2021, Section 1605, which
8 relates to county, municipal, and state floodplain
8 boards; allowing for compensation of certain board
9 members; authorizing reimbursement of certain
9 expenses; updating statutory references; and
10 providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 82 O.S. 2021, Section 1605, is
14
15 amended to read as follows:
15
16 Section 1605. A. 1. A county floodplain board shall be
16
17 composed of five (5) members to be appointed by the board of county
17
18 commissioners.
18
19 2. All the members of the board shall be residents of the
19
20 county and shall own or operate real property within the
20
21 unincorporated area of the county.
21
22 3. Two members shall be appointed for terms of two (2) years,
22
23 two members shall be appointed for terms of four (4) years and one
23

1 member shall be appointed for a term of six (6) years. Thereafter,

2 all appointments shall be made for terms of six (6) years.

3 4. All members shall serve without may receive as compensation
3
4 an amount to be established by the board of county commissioners not
4
5 to exceed One Hundred Twenty-five Dollars ($125.00) per meeting.
5
6 The members may be reimbursed expenses incurred in performance of
6
7 their duties as provided in the State Travel Reimbursement Act.

8 Members may be removed by the board of county commissioners for
8
9 cause after a public hearing for that purpose.

10 5. Vacancies shall be filled by additional appointments for the
10
11 unexpired term only.

12 B. 1. A municipal floodplain board shall be composed of five
12
13 (5) members to be appointed by the municipal governing body. All
13
14 the members of the board shall be residents of the municipality.

15 2. Membership of floodplain boards in existence prior to the
15
16 effective date of this act May 13, 1980, shall remain as currently
16
17 constituted. Membership for boards created subsequent to the
17
18 effective date of this act May 13, 1980, shall consist of two
18
19 members appointed for terms of two (2) years, two members appointed
19
20 for terms of four (4) years and one member appointed for a term of
20
21 six (6) years. Thereafter, all appointments shall be made for terms
21
22 of six (6) years.

23 3. All members shall serve without compensation may receive as

24 compensation an amount to be established by the municipal governing
