7   An Act relating to administrative rules; providing

7   for termination of administrative rules by certain

8   date; providing for renewal process; preserving

8   ability of the Legislature to repeal certain rules;

9   establishing renewal request process; requiring

9   publication of request; directing notification to

10  certain agencies; providing for codification; and

10  providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14  SECTION 1.     NEW LAW  A new section of law to be codified

14

15 in the Oklahoma Statutes as Section 328 of Title 75, unless there is
15

16 created a duplication in numbering, reads as follows:
16

17  A. Any permanent rule promulgated or amended on or after the

17

18 effective date of this act shall automatically terminate one (1)
18

19 year from the date that the rule goes into effect.
19

20  B. A rule subject to termination under this section may be

20

21 renewed for additional terms of one (1) year, or less, by the
21

22 Legislature by approval and enactment of a joint resolution.

1   C. Nothing in this section shall preclude the ability of the

2 Legislature to repeal a permanent rule prior to the automatic
2

3 termination of the rule under this section.
3

4   D. An agency may request the renewal by the Legislature of a

4

5 rule subject to automatic termination under this section. The
5

6 request shall be submitted no less than four (4) months, and no more
6

7 than six (6) months, prior to the date that the rule is set to
7

8 terminate. The agency shall demonstrate why renewal of the rule is
8

9 necessary and shall include a cost-benefit analysis. The agency
9

10 shall also publish the request on its website.

11  E. The Secretary of State shall provide notice to the

11

12 promulgating agency at least four (4) months prior to every rule's
12

13 termination date.

14  SECTION 2. This act shall become effective November 1, 2025.
