7   An Act relating to the Oklahoma Department of

7   Commerce; amending 74 O.S. 2021, Section 5017.1,

8   which relates to federal energy conservation

8   programs; requiring Department to publish and

9   annually update certain information; providing

9   contents of certain published information; updating

10  statutory language; and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
13

14  SECTION 1.     AMENDATORY   74 O.S. 2021, Section 5017.1, is

14

15 amended to read as follows:
15

16  Section 5017.1. A. The Oklahoma Department of Commerce shall

16

17 have the authority to establish, administer and enforce state and
17

18 federal energy conservation programs including, but not limited to,
18

19 implementing The Energy Conservation Act of 1975 (P.L. 94-163),
19

20 National Energy Extension Service Act (P.L. 95-39, 42 U.S.C. Section
20

21 7001 et seq.) and the National Conservation Policy Act (P.L. 95-
21

22 619), except as otherwise provided by law.

23  B. The Energy Conservation Services Division of the Oklahoma

23

24 Corporation Commission is hereby abolished. All personnel,

1 equipment, files, fixtures, funds, furniture, publications and
1

2 supplies, and all duties, functions, authority and contractual
2

3 obligations that relate to the Energy Conservation Services Division
3

4 of the Oklahoma Corporation Commission are hereby transferred to and
4

5 vested in the Oklahoma Department of Commerce.

6   C. Employees transferred to the Oklahoma Department of Commerce

6

7 shall be classified and subject to the provisions of the Merit
7

8 System of Personnel Administration as provided for in the Oklahoma
8

9 Personnel Act. The salaries, grade and/or class of the employees
9

10 transferred shall be adjusted to be commensurate with comparable
10

11 positions in the Oklahoma Department of Commerce.

12  D. The full-time-equivalent employee positions funded through

12

13 the federal energy conservation programs outlined in this section
13

14 shall terminate upon the exhaustion of said the federal funding.
14

15  E. The Department shall make publicly available on its website,

15

16 to be updated annually, information related to federal, state,
16

17 local, and tribal energy efficiency incentive programs. The
17

18 information provided shall include, but not be limited to:
18

19  1. Information regarding ongoing programs for individual

19

20 households, multi-family housing, and any other energy efficiency
20

21 incentive programs; and
21

22  2. Information that would improve collaboration between retail

22

23 energy providers and businesses, local governments, tribal
23

24 governments, and consumers, which may include:

1   a. descriptions of the territorial boundaries of retail

2                  energy providers, and

2

3   b. individuals designated by the retail energy providers

3

4                  who are responsible for facilitating the

4

5                  implementation of energy efficiency incentive programs

5

6                  with customers, local governments, and tribal

6

7                  governments.

8   SECTION 2. This act shall become effective November 1, 2025.
