7   An Act relating to wreckers and towing; creating the

7   Oklahoma Wrecker and Towing Advisory Board Act of

8   2025; providing short title; creating the Oklahoma

8   Wrecker and Towing Advisory Board within the

9   Department of Public Safety; providing for

9   appointment of members to certain Board; providing

10  duties of members of certain Board; providing for

10  noncodification; providing for codification; and

11  providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.     NEW LAW  A new section of law not to be

15

16 codified in the Oklahoma Statutes reads as follows:
16

17  This act shall be known and may be cited as the "Oklahoma

17

18 Wrecker and Towing Advisory Board Act of 2025".
18

19  SECTION 2.     NEW LAW  A new section of law to be codified

19

20 in the Oklahoma Statutes as Section 971 of Title 47, unless there is
20

21 created a duplication in numbering, reads as follows:

22  A. 1. There is hereby created within the Department of Public

22

23 Safety, the Oklahoma Wrecker and Towing Advisory Board, to be
23

24 composed of five members appointed by the Department of Public

1 Safety and two members appointed by the Corporation Commission. No

2 person shall be appointed as a member of the Board unless, at the
2

3 time of his or her appointment, he or she is a legal resident of
3

4 this state. A member shall automatically be disqualified to hold
4

5 his or her position on the Board in the event he or she ceases to be
5

6 a legal resident of this state.

7   2. The five members appointed by the Department of Public

7

8 Safety shall be appointed from the wrecker or towing industry and
8

9 shall be licensed to engage in nonconsensual towing. Of the two
9

10 members appointed by the Corporation Commission, one member shall be
10

11 engaged in vehicle repossession and one member shall be appointed
11

12 from the insurance industry. A member shall automatically be
12

13 disqualified to hold his or her position on the Board in the event
13

14 he or she ceases to meet the industry requirements for his or her
14

15 Board position.

16  B. Members shall serve until their successors in office are

16

17 duly appointed and qualified. Initial appointments of the members
17

18 shall be for terms ranging from one (1) to four (4) years, with the
18

19 Department of Public Safety and Corporation Commission designating
19

20 which member shall serve for which term. Thereafter, the terms of
20

21 all members shall be for three (3) years. In the event of the
21

22 death, resignation, disqualification, or incapacity of one or more
22

23 members of the Board, an appointment for the unexpired term of each
23

24

1 such member may be made by the appointing authority as provided in
1

2 this section.

3   C. The Board shall organize by electing one of its members as

3

4 chair and one member as vice chair. Subsequent elections for chair
4

5 and vice chair shall take place annually on a date designated by a
5

6 majority vote the Board.
6

7   D. The Board shall hold regular meetings. The date, time, and

7

8 place of any regular meeting shall be designated by the chair and
8

9 subject to the approval of a majority of the membership. Four
9

10 members of the Board shall constitute a quorum for all purposes.
10

11 The chair or vice chair may, upon approval of a majority of the
11

12 members present and voting at any meeting, designate the time,
12

13 place, and date of any scheduled special meeting, and the chair or
13

14 vice chair shall have the power to call an unscheduled special
14

15 meeting of the Board upon not less than five (5) days' notice in
15

16 writing to each member.

17  E. The Oklahoma Wrecker and Towing Advisory Board shall:

17

18  1. Serve in an advisory capacity to the Department of Public

18

19 Safety and the Corporation Commission;
19

20  2. Assist in the development of rules, standards, policies,

20

21 procedures, and directions of the Department of Public Safety and
21

22 the Corporation Commission with regards to the wrecker and towing
22

23 industry; and

1   3. Recommend specific policies and actions to the Department of

2 Public Safety and the Corporation Commission that would increase the
2

3 efficiency and safety of the wrecker and towing industry in this
3

4 state.

5   SECTION 3. This act shall become effective November 1, 2025.
