7   An Act relating to the Oklahoma Evidence Code;

7   providing for admissibility of certain statements in

8   certain proceedings; providing for codification; and

8   providing an effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12  SECTION 1.     NEW LAW  A new section of law to be codified

12

13 in the Oklahoma Statutes as Section 2803.3 of Title 12, unless there
13

14 is created a duplication in numbering, reads as follows:
14

15  A statement that purports to narrate, describe, report, or

15

16 explain an incident or incidents of domestic abuse as defined in
16

17 Section 60.1 of Title 22 of the Oklahoma Statutes:
17

18  1. Made by the victim of domestic abuse to a law enforcement

18

19 officer within one (1) week of the incident;
19

20  2. On an application for a protective order by the victim of

20

21 domestic abuse within one (1) week of the incident; or
21

22  3. Given as testimony of the victim of domestic abuse made at a

22

23 hearing on application for a protective order,

1 shall be admissible in pre-trial or post-trial criminal and juvenile
1

2 delinquent domestic abuse prosecutions including preliminary
2

3 hearings, prosecutive merit hearings, or hearings on the revocation
3

4 of probation or acceleration of a deferred judgment.

5   SECTION 2. This act shall become effective November 1, 2025.
