7   An Act relating to schools; requiring certain school

7   district or technology center school to provide

8   certain attestation to a school district or

8   technology center school considering an individual

9   for employment; providing for contents of

9   attestation; requiring attestation to be provided on

10  certain form; requiring certain actions for failure

10  to request or provide certain attestation; providing

11  for codification; providing an effective date; and

11  declaring an emergency.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
15

16  SECTION 1.     NEW LAW   A new section of law to be codified

16

17 in the Oklahoma Statutes as Section 6-101.25a of Title 70, unless
17

18 there is created a duplication in numbering, reads as follows:
18

19  A. A school district or technology center school that is

19

20 considering an individual for employment shall request from the
20

21 individual's current or former employing school district or
21

22 districts or technology center school or schools an attestation to
22

23 whether allegations of inappropriate behavior between the individual
23

24 and a student or students were raised and whether there was a
24

1 pending or ongoing investigation of inappropriate behavior between
1

2 the individual and a student or students. The attestation shall be
2

3 provided on forms prescribed by the State Department of Education or
3

4 the Oklahoma Department of Career and Technology Education.

5   B. If a school district or technology center school fails to

5

6 request or fails to provide an attestation required by subsection A
6

7 of this section:
7

8   1. The superintendent of the school district or technology

8

9 center school shall be dismissed or not reemployed, subject to the
9

10 provisions of the Teacher Due Process Act of 1990; and
10

11  2. The board positions of the school district board of

11

12 education or technology center school district board of education
12

13 shall be declared vacant, and individuals who held such positions
13

14 shall be ineligible to serve on a school district board of education
14

15 or technology center school district board of education for five (5)
15

16 years. The Governor shall appoint board of education members
16

17 necessary to constitute a quorum, as provided for in subsection F of
17

18 Section 13A-110 of Title 26 of the Oklahoma Statutes.
18

19  C. If a school district or technology center school fails to

19

20 provide an attestation required by subsection A of this section and
20

21 a subsequent employing school district or technology center school
21

22 is found liable in a civil action or agrees to a settlement of a
22

23 civil action, the school district or technology center school that
23

24 failed to provide the attestation shall be required to provide fifty
24

1 percent (50%) of any monetary damages imposed by a court in the
1

2 civil action or fifty percent (50%) of any settlement amount agreed
2

3 upon by the parties and approved by the court.
3

4   SECTION 2. This act shall become effective July 1, 2025.

4

5   SECTION 3. It being immediately necessary for the preservation

5

6 of the public peace, health, or safety, an emergency is hereby
6

7 declared to exist, by reason whereof this act shall take effect and
7

8 be in full force from and after its passage and approval.
