7 An Act relating to unconstitutional actions in
7 Oklahoma; creating the Ethan Haim Act; providing
8 short title; providing legislative intent; defining
8 terms; providing for unlawful action; specifying
9 violations; providing for certain penalties; allowing
9 certain damages and relief; prohibiting certain
10 contracts and actions; authorizing certain entities
10 with powers; providing for certain disclaimer;
11 stating severability; providing for noncodification;
11 providing for codification; providing an effective
12 date; and declaring an emergency.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. NEW LAW A new section of law not to be
16
17 codified in the Oklahoma Statutes reads as follows:
17
18 This act shall be known and may be cited as the "Ethan Haim
18
19 Act".

22 The Legislature finds that:

1 1. The Tenth Amendment to the United States Constitution

2 reserves to the states and the people all powers not delegated to
2
3 the federal government;
3
4 2. The federal executive branch has expanded far beyond its
4
5 constitutional boundaries, with numerous agencies assuming powers
5
6 and responsibilities not granted by the United States Constitution;
6
7 3. This expansion has infringed on the rights of states and
7
8 their citizens, undermining federalism and Oklahoma's sovereignty;
8
9 4. The United States Constitution guarantees inalienable
9
10 rights, including those enumerated in the First, Second, and Fourth
10
11 Amendments, as well as protections of individual autonomy in matters
11
12 such as medical freedom;
12
13 5. Whistleblowers play a critical role in exposing illegal,
13
14 unethical, or unconstitutional actions and must be protected from
14
15 retaliation or prosecution; and
15
16 6. Any actions by federal agents or entities that infringe upon
16
17 these rights or exceed the federal government's enumerated powers
17
18 are unconstitutional and an affront to the liberty of Oklahoma
18
19 residents.
19
20 It is the intent of this act to establish penalties, including
20
21 deportation, to deter unconstitutional actions, protect
21
22 whistleblowers, and affirm Oklahoma's responsibility to defend its
22
23 citizens' rights and sovereignty.

1 SECTION 3. NEW LAW A new section of law to be codified

2 in the Oklahoma Statutes as Section 13000 of Title 74, unless there
2
3 is created a duplication in numbering, reads as follows:
3
4 For purposes of this act:
4
5 1. "Agent" refers to any representative, employee, or
5
6 contractor of a federal agency;
6
7 2. "Entity" includes federal agencies, organizations, or other
7
8 bodies acting under federal authority;
8
9 3. "Unconstitutional action" means:
9
10 a. any activity, investigation, enforcement, or operation
10
11 that infringes upon rights guaranteed under the United
11
12 States Constitution or the Oklahoma Constitution, or
12
13 b. any action usurping powers not expressly granted to
13
14 the federal government under the United States
14
15 Constitution; and
15
16 4. "Whistleblower" refers to any individual who, in good faith,
16
17 reports or discloses illegal, unconstitutional, or unethical actions
17
18 within federal or state agencies.

19 SECTION 4. NEW LAW A new section of law to be codified
19
20 in the Oklahoma Statutes as Section 13001 of Title 74, unless there
20
21 is created a duplication in numbering, reads as follows:
21
22 A. It shall be unlawful for any agent or entity to engage in
22
23 activities that violate the constitutional rights of Oklahoma
23
24 residents while operating within the state.

1 B. Specific violations include, but are not limited to:

2 1. Actions infringing upon freedom of speech, religion, or the
2
3 press;
3
4 2. Seizure or restriction of firearms not supported by
4
5 constitutional authority;
5
6 3. Search and seizure actions without probable cause or due
6
7 process;
7
8 4. Coercion or retaliation against individuals for protected
8
9 expressions or lawful decisions; and
9
10 5. Prosecution, intimidation, or retaliation against
10
11 whistleblowers who expose illegal or unconstitutional actions.
11
12 C. Any federal agent found guilty of engaging in
12
13 unconstitutional actions within Oklahoma shall be ordered to leave
13
14 the state immediately and shall be prohibited from returning to the
14
15 state for a minimum of one (1) year, shall be subject to civil
15
16 liability for damages caused by his or her unconstitutional actions,
16
17 and shall be fined Thirty-five Thousand Dollars ($35,000.00) per day
17
18 of violation.
18
19 D. Any entity operating in violation of this act shall cease
19
20 all operations within the state and remove all representatives,
20
21 employees, or agents within thirty (30) days of a court order, shall
21
22 be prohibited from re-establishing operations within Oklahoma for a
22
23 minimum of one (1) year, shall be subject to civil liability for

1 damages caused by their unconstitutional actions, and shall be fined
1
2 Five Hundred Thousand Dollars ($500,000.00) per day of violation.
2
3 E. Oklahoma residents harmed by unconstitutional actions may
3
4 bring civil suits against individuals, agents, or entities. Civil
4
5 suits may seek compensatory and punitive damages, as well as
5
6 injunctive relief.
6
7 F. Any individual or entity deported under this act shall be
7
8 barred from entering into contracts or enforcement actions within
8
9 the state during the prohibition period.
9
10 G. The Attorney General is authorized to investigate,
10
11 prosecute, and enforce penalties, including deportation, for
11
12 violations of this act. District attorneys shall have concurrent
12
13 jurisdiction with the Attorney General to prosecute violations of
13
14 this act and petition for deportation. Upon a finding of guilt, the
14
15 court may order the immediate deportation of the individual or
15
16 entity from Oklahoma for a period of time sufficient to prevent
16
17 further violations. Local law enforcement agencies may detain
17
18 individuals suspected of unconstitutional actions until adjudication
18
19 or deportation.
19
20 H. This act does not apply to actions explicitly authorized by
20
21 the United States Constitution and adjudicated as lawful by the
21
22 Oklahoma Supreme Court or the United States Supreme Court.
22
23 I. If any provision of this act is found to be
23
24 unconstitutional, the remaining provisions shall remain in effect.

1 SECTION 5. This act shall become effective July 1, 2025.

2 SECTION 6. It being immediately necessary for the preservation
2
3 of the public peace, health or safety, an emergency is hereby
3
4 declared to exist, by reason whereof this act shall take effect and
4
5 be in full force from and after its passage and approval.
