9 An Act relating to firearms; considering certain
9 action as infringing on the right to keep and bear
10 arms; directing courts and law enforcement agencies
10 to protect certain rights of law-abiding citizens;
11 prohibiting law enforcement officers from obeying or
11 enforcing certain orders; prohibiting the termination
12 or retaliation against law enforcement officers for
12 refusing to obey or enforce certain orders;
13 prohibiting the state, counties, and municipalities
13 from making cuts to funds or budgets of county
14 sheriffs' offices or municipal police departments
14 under certain circumstances; defining term; providing
15 for codification; and declaring an emergency.

18 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

19 SECTION 1. NEW LAW A new section of law to be codified
19
20 in the Oklahoma Statutes as Section 2201 of Title 25, unless there
20
21 is created a duplication in numbering, reads as follows:
21
22 Any federal, state, county, or municipal act, law, executive
22
23 order, administrative order, court order, rule, or regulation
23
24 ordering the confiscation of firearms, firearm accessories, or

1 ammunition from law-abiding citizens of this state shall be
1
2 considered an infringement on the rights of citizens to keep and
2
3 bear arms as guaranteed by the Second Amendment to the Constitution
3
4 of the United States and Article II, Section 26 of the Oklahoma
4
5 Constitution.

6 SECTION 2. NEW LAW A new section of law to be codified
6
7 in the Oklahoma Statutes as Section 2202 of Title 25, unless there
7
8 is created a duplication in numbering, reads as follows:

9 It shall be the duty of the courts and law enforcement agencies
9
10 of this state to protect the rights of law-abiding citizens to keep
10
11 and bear arms within the borders of this state and to protect such
11
12 rights from the infringement provided under the provisions of
12
13 Section 1 of this act.

14 SECTION 3. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 2203 of Title 25, unless there
15
16 is created a duplication in numbering, reads as follows:
16
17 A. No law enforcement officer shall obey or enforce any direct
17
18 or indirect order which violates the Second Amendment to the
18
19 Constitution of the United States; Article II, Section 26 of the
19
20 Oklahoma Constitution; or the law enforcement oath of the law
20
21 enforcement officer.

22 B. Any agency or department of this state, county, or
22
23 municipality shall be prohibited from terminating or retaliating
23
24 against any law enforcement officer who refuses to obey or enforce

1 any order which violates the Second Amendment to the Constitution of
1
2 the United States; Article II, Section 26 of the Oklahoma
2
3 Constitution; or the law enforcement oath of the law enforcement
3
4 officer.

5 C. The State of Oklahoma and any county or municipal government
5
6 shall not cut any funding or budget from a county sheriff's office
6
7 or municipal police department for:
7
8 1. Refusing to obey or enforce any order which violates the
8
9 Second Amendment to the Constitution of the United States; Article
9
10 II, Section 26 of the Oklahoma Constitution; or the law enforcement
10
11 oath of a law enforcement officer; or
11
12 2. Making any county or municipality a Second Amendment
12
13 sanctuary county or municipality.

14 SECTION 4. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 2204 of Title 25, unless there
15
16 is created a duplication in numbering, reads as follows:

17 For the purposes of Sections 1 and 2 of this act, the term "law-
17
18 abiding citizen" shall mean a person who is not otherwise precluded
18
19 under federal or state law from possessing a firearm and shall not
19
20 be construed to include anyone who is not legally present in the
20
21 United States or this state.
21
22 SECTION 5. It being immediately necessary for the preservation
22
23 of the public peace, health or safety, an emergency is hereby
23

1 declared to exist, by reason whereof this act shall take effect and

2 be in full force from and after its passage and approval.
