7   An Act relating to elections; amending 26 O.S. 2021,

7   Section 2-121, which relates to offices of county

8   election boards; requiring county election board to

8   provide certain training; and providing an effective

9   date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.     AMENDATORY   26 O.S. 2021, Section 2-121, is

13

14 amended to read as follows:
14

15  Section 2-121. A. It shall be the mandatory duty of the county

15

16 commissioners of each county to furnish, at county expense, in each
16

17 county seat a suitable office for the county election board. The
17

18 office shall provide adequate space for storage of election records
18

19 and supplies, voting devices, ballot boxes, and adequate space for
19

20 the exercise of other functions required by law of the county
20

21 election board and shall be equipped with suitable furniture, and
21

22 office equipment, and a telephone. The office shall be convenient
22

23 to the public, shall have furniture, furnishings and fixtures, and
23

24

24

1 other equipment comparable to other county offices within the

2 county, and necessary to the operation of the office.

3   B. 1. The county commissioners of each county shall, at county

3

4 expense, implement security measures at the county election board
4

5 that are equivalent to security measures the county provides to its
5

6 other county agencies, in order to ensure the county election board
6

7 office is adequately protected from physical intrusions or attacks
7

8 and to provide cybersecurity for county-owned computer systems
8

9 operated by the county election board.

10  2. County officials shall immediately notify the Secretary of

10

11 the State Election Board upon learning of an attempted or successful
11

12 physical or cyber attack or intrusion committed against the county
12

13 election board.
13

14  C. To ensure the security of election records, equipment,

14

15 computers, software, ballots, supplies, and other materials
15

16 necessary to conduct elections:
16

17  1. The county election board shall not share storage space

17

18 where ballots, voter registration records, or election equipment are
18

19 stored with any other county agency unless authorized by the
19

20 Secretary of the State Election Board; and
20

21  2. No county personnel other than those employed by the county

21

22 election board shall be assigned workspace within the physical
22

23 offices that are assigned to the county election board; and

1   3. The county election board shall provide sufficient training,

2 approved by the Secretary of the State Election Board, to the county
2

3 sheriff and law enforcement officers of the county in order to
3

4 secure the election process pursuant to state law as well as secure
4

5 ballots pursuant to subsection C of Section 14-115.4 of this title.
5

6   Provided, nothing in this subsection shall prohibit the county

6

7 election board office from being located within the county
7

8 courthouse or another county-owned building shared by multiple
8

9 county agencies, nor shall it restrict the county election board
9

10 from utilizing common areas intended for use by multiple county
10

11 agencies other than as specifically prohibited in this subsection.
11

12  D. The Secretary of the State Election Board shall have the

12

13 authority to enforce the requirements of, and may promulgate
13

14 administrative rules to implement the provisions of, this section.
14

15  SECTION 2. This act shall become effective November 1, 2025.
