7 An Act relating to municipalities; defining terms;
7 prohibiting certain municipalities from maintaining
8 certain services; requiring the termination of
8 certain services on certain date; providing for
9 codification; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 22-140 of Title 11, unless there
14
15 is created a duplication in numbering, reads as follows:

16 A. As used in this section:
16
17 1. "Homeless person" or "homeless persons" means any person or
17
18 persons who:
18
19 a. lacks a fixed, regular, and adequate nighttime
19
20 residence,
20
21 b. has as a primary nighttime residence a publicly or
21
22 privately operated shelter designed to provide
22
23 temporary living accommodations, or
23

1 c. has as a primary nighttime residence a public or

2 private place not designed for, or ordinarily used as,
2
3 a regular sleeping accommodation for human beings.
3
4 The term includes those persons and families who do not have
4
5 access to normal accommodations as a result of violence or the
5
6 threat of violence from a cohabitant; and
6
7 2. "Homeless shelter" means a facility providing temporary
7
8 housing and services for homeless persons.

9 B. No municipality of this state with a population less than
9
10 three hundred thousand (300,000) according to the most recent
10
11 Federal Decennial Census shall provide programs or services to
11
12 homeless persons including, but not limited to, owning or leasing
12
13 land for the purpose of building or maintaining a homeless shelter.
13
14 C. Any municipality that meets the population requirement set
14
15 forth in subsection B of this section that is providing programs or
15
16 services to homeless persons on the effective date of this act shall
16
17 immediately terminate such services and, if the municipality
17
18 currently owns or leases land for the purpose of building or
18
19 maintaining a homeless shelter, cease using the land for such
19
20 purpose.

21 SECTION 2. This act shall become effective November 1, 2025.
