7 An Act relating to natural gas; amending 17 O.S.
7 2021, Section 801.5, which relates to natural gas
8 energy standard; establishing natural gas as
8 preferred fuel source for new generation; updating
9 statutory language; providing an effective date; and
9 declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 17 O.S. 2021, Section 801.5, is
13
14 amended to read as follows:
14
15 Section 801.5. A. The Legislature declares that it is in the
15
16 public interest to promote natural gas energy development in order
16
17 to take advantage of our state's vast natural gas resources and its
17
18 compatibility with wind energy.

19 B. It is further declared the intent of the Legislature to
19
20 promote natural gas energy development in this state by establishing
20
21 a natural gas energy standard to increase the use of natural gas as
21
22 an electricity generation fuel.

23 C. There is hereby established a natural gas energy standard to
23
24 supplement the increased volume of renewable energy and to

1 capitalize on the state's abundant natural gas resources. The

2 natural gas energy standard shall be achieved by declaring natural
2
3 gas as the preferred choice of electric generation for new fossil
3
4 fuel generating facilities in this state after the effective date of
4
5 this act through January 1, 2020.

6 D. Beginning January 1, 2011, through January 1, 2020, it It is
6
7 the intent of the state that new fossil fuel generating facilities
7
8 and added capacity to existing fossil fuel generating facilities
8
9 built in this state be powered by natural gas. Any electricity
9
10 generating entity in the state choosing a fossil fuel source other
10
11 than natural gas may provide evidence to the Corporation Commission,
11
12 or other appropriate regulatory body of those entities not regulated
12
13 by the Commission, that the fossil fuel source chosen by such entity
13
14 is in the best interest of this state's electric consumers.

15 SECTION 2. This act shall become effective July 1, 2025.
15
16 SECTION 3. It being immediately necessary for the preservation
16
17 of the public peace, health or safety, an emergency is hereby
17
18 declared to exist, by reason whereof this act shall take effect and
18
19 be in full force from and after its passage and approval.
