7 An Act relating to schools; amending 70 O.S. 2021,
7 Section 1210.545, which relates to annual reports for
8 the Oklahoma School Testing Program; modifying grades
8 and descriptions of grades to be given to schools;
9 removing language directing certain performance to
9 not be included in determining certain grade;
10 removing ability to adopt alternative accountability
10 system for virtual charter schools; requiring
11 academic measures for certain schools to include
11 certain measures to support learning outside of
12 school; requiring certain additional measure to
12 include certain strategies to improve school-based
13 social support services; updating statutory language;
13 providing an effective date; and declaring an
14 emergency.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

17 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1210.545, is
17
18 amended to read as follows:
18
19 Section 1210.545. A. Except as otherwise provided, as part of
19
20 the accountability system developed as provided for in Section
20
21 1210.541 of this title, the State Board of Education shall prepare
21
22 annual reports of the results of the Oklahoma School Testing Program
22
23 which describe student achievement in the state, and each school
23
24 site, pursuant to the Elementary and Secondary Education Act of 1965

1 (ESEA) as reauthorized by P.L. No. 114-95, also known as the Every
1
2 Student Succeeds Act (ESSA), and any related federal regulations.
2
3 B. The annual report as required pursuant to subsection A of
3
4 this section shall identify school sites as having one of the
4
5 following grades for each indicator, separately, and by a single
5
6 overview grade of all indicators, defined according to rules of the
6
7 State Board of Education:
7
8 1. "A" means schools making excellent progress;
8
9 2. "B" means schools making above average progress;
9
10 3. "C" 2. "B" means schools making satisfactory progress; and
10
11 4. "D" 3. "C" means schools making less than satisfactory
11
12 progress; and
12
13 5. "F" means schools failing to make adequate progress in need
13
14 of support.
14
15 C. Each school that has students who are tested and included in
15
16 the school grading system as provided for in this section shall
16
17 receive a school grade, except as follows:
17
18 1. A school shall not receive a school grade if the number of
18
19 students tested and included in the school grading system is less
19
20 than the minimum sample size necessary for statistical reliability
20
21 and prevention of the unlawful release of personally identifiable
21
22 student data. The State Board of Education is directed to establish
22
23 the lowest minimum sample size necessary to meet the requirements of
23
24 this paragraph; and

1 2. The academic performance of students who are enrolled full-
1
2 time in an online program that is offered by a school district or
2
3 charter school that is not the district of residence or is not
3
4 located in the district of residence of the student shall be
4
5 reported separately by the school district or charter school and
5
6 shall not be included when determining the grade of the school site
6
7 or charter school.

8 D. The State Board of Education may adopt alternate systems of
8
9 accountability for statewide virtual charter schools, alternative
9
10 education programs as defined in Section 1210.568 of this title, and
10
11 schools serving only grades prekindergarten or kindergarten through
11
12 two.

13 E. The grade of a school shall be based on a multimeasures
13
14 approach to accountability in accordance with the Elementary and
14
15 Secondary Education Act of 1965 (ESEA) as reauthorized by P.L. No.
15
16 114-95, also known as the Every Student Succeeds Act (ESSA) and any
16
17 federal regulations that include, but are not limited to, the
17
18 following indicators:
18
19 1. Statewide assessments, including the establishment of
19
20 student performance bands;
20
21 2. Graduation rates for high schools;
21
22 3. Statewide academic measures for elementary and middle
22
23 schools including measures to empower and equip parents or legal
23

1 guardians of students to successfully support learning outside of
1
2 school;
2
3 4. English language proficiency for English learners; and
3
4 5. At least one additional statewide measure of school quality
4
5 or student success, including, but not limited to, school climate,
5
6 school safety, student engagement, educator engagement, and/or
6
7 advanced coursework and postsecondary readiness, and school-based
7
8 social support services including strategies to bring community-
8
9 based counseling, family support services, health care, eye care,
9
10 dental care, food, and school-based counseling, based upon parent or
10
11 legal guardian surveys, town halls, parent or legal guardian
11
12 engagement and support trainings, parent or legal guardian mentoring
12
13 and support, training parents or legal guardians on technology, and
13
14 parents or legal guardians helping students with homework outside of
14
15 the classroom.

16 F. Of the indicators included in subsection E of this section,
16
17 not less than seventy percent (70%) of the overview grade must be
17
18 given to indicators 1, 2, 3, and 4 and, in the aggregate, with not
18
19 more than thirty percent (30%) of the grade given to indicator 5.
19
20 G. Further, the grade of an elementary or middle school site
20
21 shall include, but not be limited to, a measure of status for
21
22 English language arts (ELA), math, and science, growth in ELA and
22
23 math, English Language Proficiency Assessment (ELPA) progress, and
23
24 chronic absenteeism.

1 H. The grade of a high school site shall include, but not be
1
2 limited to, a measure of status for English language arts (ELA),
2
3 math, and science status, English Language Proficiency Assessment
3
4 (ELPA) progress, graduation rate, chronic absenteeism, and
4
5 postsecondary opportunities. For purposes of this section,
5
6 postsecondary opportunities shall include Advanced Placement
6
7 advanced placement, International Baccalaureate, dual and concurrent
7
8 enrollment, internships, mentorships and apprenticeships, and
8
9 industry certifications. The Board shall adopt a time line timeline
9
10 for moving from completion of such opportunities to crediting
10
11 achievement of such opportunities.

12 I. The annual report shall identify the performance of each
12
13 school as having improved, remained the same, or declined. This
13
14 school improvement rating shall be based on a comparison of the
14
15 student and school performance data of the current year to the
15
16 previous year data.

17 J. The State Department of Education shall annually develop a
17
18 school site report card to be delivered to parents throughout each
18
19 school district. The report card shall be in accordance with the
19
20 requirements of the Elementary and Secondary Education Act of 1965
20
21 (ESEA), as reauthorized and amended by P.L. No. 114-95, also known
21
22 as the Every Student Succeeds Act (ESSA) and includes the grade for
22
23 the school, information regarding school improvement, an explanation
23
24 of school performance, and indicators of return on investment. The

1 report card for each school site shall be published annually by the
1
2 Department on its website, and every school district shall provide
2
3 the school site report card to the parent or guardian of each
3
4 student enrolled in the school site. In order to provide
4
5 information regarding school performance for school report cards
5
6 issued during the 2016-2017 and 2017-2018 school year, the
6
7 Department shall include an explanation of the changes to the
7
8 statewide system of student assessments as required in Section
8
9 1210.508 of this title and how the transition in assessments may
9
10 impact school performance. The Department shall issue school report
10
11 cards using the 2016-2017 school year assessment data that is
11
12 available.

13 K. The Legislature may factor in the performance of schools in
13
14 calculating any performance-based funding policy that is provided to
14
15 public school districts.

16 L. The State Board of Education shall promulgate rules to
16
17 implement the provisions of this section.

18 SECTION 2. This act shall become effective July 1, 2025.
18
19 SECTION 3. It being immediately necessary for the preservation
19
20 of the public peace, health, or safety, an emergency is hereby
20
21 declared to exist, by reason whereof this act shall take effect and
21
22 be in full force from and after its passage and approval.
