7   An Act relating to state property; permitting

7   residents to forage for nuts and edible plants on

8   state-owned or state-managed property; providing

8   exceptions; defining terms; providing for

9   codification; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
12

13  SECTION 1.         NEW LAW  A new section of law to be codified

13

14 in the Oklahoma Statutes as Section 335 of Title 61, unless there is
14

15 created a duplication in numbering, reads as follows:
15

16  A. Any person may forage for nuts and edible plants on state-

16

17 owned or state-managed property for personal use and not for resale
17

18 except when such nuts and other edible plants are:
18

19  1. From crops certified by the Oklahoma Agricultural Experiment

19

20 Station system or the Oklahoma Cooperative Extension Service of the
20

21 Oklahoma State University Division of Agricultural Sciences and
21

22 Natural Resources, as provided in Section 8-33 of Title 2 of the
22

23 Oklahoma Statutes;

1   2. Located on state-owned or University-owned test or research

2 farms;
2

3   3. On property otherwise restricted for access by state or

3

4 federal law; or
4

5   4. From plants that are threatened or endangered.

5

6   B. As used in this section:

6

7   1. "State-owned or state-managed property" means property owned

7

8 or managed by an agency, municipality, or political subdivision of
8

9 this state, unless otherwise stated in subsection A of this section;
9

10  2. "Edible plant" means a plant commonly found in the wild,

10

11 which is edible to humans in part or in its entirety and may require
11

12 cooking to make safe for consumption; and
12

13  3. "Nut" means a dry fruit that has a single seed, a hard

13

14 shell, and a protective husk.

15  SECTION 2. This act shall become effective November 1, 2025.
