7   An Act relating to the state Medicaid program;

7   requiring certain coverage of chiropractic care;

8   prohibiting certain exclusion from coverage;

8   preventing certain prior authorization requirement;

9   directing promulgation of rules; requiring Oklahoma

9   Health Care Authority to seek necessary federal

10  approval; providing for codification; providing an

10  effective date; and declaring an emergency.

1 3 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14  SECTION 1.     NEW LAW  A new section of law to be codified

14

1 5 in the Oklahoma Statutes as Section 5029.2 of Title 63, unless there

15

1 6 is created a duplication in numbering, reads as follows:

16

17  A. The state Medicaid program shall cover chiropractic care

17

1 8 performed by licensed chiropractic physicians when such services are

18

1 9 medically necessary for the diagnosis and treatment of illness or

19

2 0 injury or to improve the functioning of a malformed body member.

20

21  B. The state Medicaid program shall not exclude members from

21

2 2 coverage under this section on the basis of age.

22

23  C. No prior authorization shall be required for a member to

23

2 4 receive medically necessary chiropractic care.

1   D. The Oklahoma Health Care Authority Board shall promulgate

2 rules as necessary to implement the provisions of this section.

2

3   E. The Oklahoma Health Care Authority shall seek any federal

3

4 approval necessary to implement the provisions of this section.

5   SECTION 2. This act shall become effective July 1, 2025.

5

6   SECTION 3. It being immediately necessary for the preservation

6

7 of the public peace, health or safety, an emergency is hereby

7

8 declared to exist, by reason whereof this act shall take effect and

8

9 be in full force from and after its passage and approval.
