6 An Act relating to child care; amending 10 O.S. 2021,
6 Section 405.4, which relates to education and
7 continuing education requirements; extending
7 continuing education cycle; requiring certain
8 certificate for child care facility personnel within
8 specified time frame; requiring infant safe sleep
9 training for certain individuals; and providing an
9 effective date.

1 2 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 10 O.S. 2021, Section 405.4, is
13
1 4 amended to read as follows:
14
15 Section 405.4. A. Any person with a bachelor's degree or
15
1 6 postgraduate degree shall be considered as having met the
16
1 7 educational requirements for a director of a full-time child care
17
1 8 center required by the Department of Human Services. Nothing in
18
1 9 this section shall be construed as to affect annual continuing
19
2 0 education requirements. The director of a child care center may
20
2 1 also qualify as a master teacher for children of all ages.
21
22 B. Any person replacing a master teacher at a child care center
22
2 3 shall be granted a one-year probationary period to fulfill the
23
2 4 educational qualifications required by the Department for a master
24

1 teacher. The Department may extend the probationary period an
1
2 additional year as long as the person is actively pursuing that
2
3 goal.

4 C. 1. Prior to or within twelve (12) months of employment,
4
5 teaching personnel of child care facilities shall obtain and
5
6 maintain a current Oklahoma Professional Development Ladder (OPDL)
6
7 certificate as provided by rules promulgated by the Director of
7
8 Human Services.

9 2. Renewals and training for OPDL certification and any other
9
1 0 professional development or continuing education required by the
10
1 1 Department for child care facility personnel shall be on a two-year
11
1 2 cycle.

13 3. Infant safe sleep training shall be required every two (2)
13
1 4 years for any individual working with infants under one (1) year of
14
1 5 age.

16 D. Licensed child care facilities opened or expanded before
16
1 7 November 1, 2016, shall have thirty-five (35) square feet of floor
17
1 8 area per infant in rooms occupied only by infants. New construction
18
1 9 and existing space not previously licensed for child care after
19
2 0 November 1, 2016, shall have forty (40) square feet of floor area
20
2 1 per infant in rooms occupied only by infants.
21
22 SECTION 2. This act shall become effective November 1, 2025.
