7 An Act relating to health care facilities; requiring
7 facilities to publish all policies and procedures;
8 directing promulgation of rules; requiring facilities
8 to establish certain policies and procedures;
9 granting certain rights related to medical records;
9 providing for codification; and providing an
10 effective date.

1 3 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
1 5 in the Oklahoma Statutes as Section 1-712.1 of Title 63, unless
15
1 6 there is created a duplication in numbering, reads as follows:
16
17 A hospital, medical facility, or long-term care facility
17
1 8 licensed by the State Department of Health shall publish on its
18
1 9 website, and keep updated, all policies and procedures of the
19
2 0 hospital, medical facility, or long-term care facility. The State
20
2 1 Commissioner of Health shall promulgate rules to implement this
21
2 2 section.

1 SECTION 2. NEW LAW A new section of law to be codified

2 in the Oklahoma Statutes as Section 1-712.2 of Title 63, unless
2
3 there is created a duplication in numbering, reads as follows:
3
4 A. A hospital, medical facility, or long-term care facility
4
5 licensed by the State Department of Health shall establish policies
5
6 and procedures necessary to track and document all additions,
6
7 deletions, and other edits to a patient's medical records.
7
8 B. Any person shall have the right to obtain, upon request,
8
9 detailed information of all additions, deletions, and other edits to
9
1 0 his or her medical records made by a hospital, medical facility, or
10
1 1 long-term care facility, or those of:
11
12 1. A minor child of whom the person is the parent or legal
12
1 3 guardian; or
13
14 2. Any other patient who lacks capacity to make medical
14
1 5 decisions and for whom the person has legal authority to make such
15
1 6 decisions and would have legal access to the patient's medical
16
1 7 records.

18 SECTION 3. This act shall become effective November 1, 2025.
