7   An Act relating to firearms; amending 21 O.S. 2021,

7   Section 1289.24e, which relates to the Second

8   Amendment Sanctuary State Act; modifying scope of

8   certain infringement; updating statutory language;

9   updating statutory references; and providing an

9   effective date.

1 2 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.     AMENDATORY    21 O.S. 2021, Section 1289.24e, is

13

1 4 amended to read as follows:

14

15  Section 1289.24e. A. The State Legislature hereby occupies and

15

1 6 preempts the entire field of legislation by any agency of this state

16

1 7 or any political subdivision in this state to infringe upon the

17

1 8 rights of a citizen of the State of Oklahoma this state, the

18

1 9 unalienable right to keep and bear arms as guaranteed to them by the

19

2 0 Second Amendment of the United States Constitution.

20

21  B. Any federal, state, county, or municipal act, law, executive

21

2 2 order, administrative order, court order, rule, policy, or

22

2 3 regulation ordering that offers or orders the buy-back,

23

2 4 confiscation, or surrender of firearms, firearm accessories, or

24

1 ammunition from law-abiding citizens of this state shall be

1

2 considered an infringement on the rights of citizens to keep and

2

3 bear arms as guaranteed by the Second Amendment of the Constitution

3

4 of the United States and Article II, Section 26 of the Constitution

4

5 of Oklahoma United States Constitution and Section 26 of Article II

5

6 of the Oklahoma Constitution.

7   C. It shall be the duty of the courts and law enforcement

7

8 agencies of this state to protect the rights of law-abiding citizens

8

9 to keep and to bear arms within the borders of this state and to

9

1 0 protect these rights from the infringement provided under the

10

1 1 provisions of this act the Second Amendment Sanctuary State Act.

11

12  D. The preemption provided in this act the Second Amendment

12

1 3 Sanctuary State Act shall include:

13

14  1. Any regulation of arms and ammunition, pursuant to the

14

1 5 National Firearms Act of 1934, prohibited or regulated on or after

15

1 6 the effective date of this act April 26, 2021; and

16

17  2. Any regulations regulation or provision of the Gun Control

17

1 8 Act of 1968, prohibited or regulated on or after the effective date

18

1 9 of this act April 26, 2021.

19

20  E. For purposes of this section:

20

21  1. "Arms" is defined as means any firearm, firearm part,

21

2 2 accessory, or ammunition required to render that firearm operable

22

2 3 and effective;

1   2. "Infringement" shall mean means any law that reduces,

1

2 represses, diminishes, or subverts the right to keep and bear arms,

2

3 ammunition, parts, and accessories in any amount that is legal as of

3

4 the effective date of this act April 26, 2021, of any citizen in

4

5 this state; and

5

6   3. "Law-abiding citizen" means a person who is not otherwise

6

7 precluded under state law from possessing a firearm and shall not be

7

8 construed to include anyone who is not legally present in the United

8

9 States or this state.

10  SECTION 2. This act shall become effective November 1, 2025.
