7 An Act relating to federal funds; directing public
7 school districts that receive certain federal funds
8 to provide professional development for certain
8 teachers; defining term; providing for promulgation
9 of rules; providing for codification; providing an
9 effective date; and declaring an emergency.

1 2 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
1 4 in the Oklahoma Statutes as Section 18-202.2 of Title 70, unless
14
1 5 there is created a duplication in numbering, reads as follows:

16 A. Notwithstanding any other provision of federal law, public
16
1 7 school districts that receive federal funding through the Elementary
17
1 8 and Secondary Education Act of 1965 (ESEA) as reauthorized by P.L.
18
1 9 No. 114-95, also known as the Every Student Succeeds Act (ESSA), to
19
2 0 ensure that English learners attain English language proficiency
20
2 1 shall use fifty percent (50%) of the funds to provide professional
21
2 2 development for teachers who offer instruction in English as a
22
2 3 second language. For the purposes of this section, "English
23
2 4 learner" shall mean a student who has limited English speaking

1 abilities or who comes from a home where English is not the dominant

2 language as reported on the current year application for
2
3 accreditation.

4 B. The State Board of Education may promulgate rules to monitor
4
5 compliance with subsection A of this section.
5
6 SECTION 2. This act shall become effective July 1, 2025.
6
7 SECTION 3. It being immediately necessary for the preservation
7
8 of the public peace, health, or safety, an emergency is hereby
8
9 declared to exist, by reason whereof this act shall take effect and
9
1 0 be in full force from and after its passage and approval.
