7   An Act relating to commercial driver training;

7   amending 47 O.S. 2021, Section 804, as amended by

8   Section 28, Chapter 310, O.S.L. 2023 (47 O.S. Supp.

8   2024, Section 804), which relates to instructor's

9   licenses; directing Service Oklahoma to promulgate

9   certain rules; and declaring an emergency.

1 2 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.     AMENDATORY  47 O.S. 2021, Section 804, as

13

1 4 amended by Section 28, Chapter 310, O.S.L. 2023 (47 O.S. Supp. 2024,

14

1 5 Section 804), is amended to read as follows:

15

16  Section 804. A. No person shall act as an instructor unless

16

1 7 such person applies for and obtains from Service Oklahoma a license

17

1 8 in the manner and form prescribed by Service Oklahoma.

18

19  B. Rules promulgated by Service Oklahoma, in conjunction with

19

2 0 the Department of Public Safety, shall state the requirements for an

20

2 1 instructor's license, including requirements concerning moral

21

2 2 character, physical condition, knowledge of the courses of

22

2 3 instruction, motor vehicle laws and safety principles and practices,

23

2 4 previous personnel and employment records, and such other matters as

1 Service Oklahoma, in conjunction with the Department of Public

1

2 Safety, may prescribe for the protection of the public.

3   C. Rules promulgated by Service Oklahoma under the provisions

3

4 of subsection B of this section shall require an applicant for the

4

5 license to have three (3) years of verifiable commercial driving

5

6 experience within ten (10) years of the application date or three

6

7 (3) years of verifiable experience as an instructor at a commercial

7

8 driver training school within ten (10) years of the application

8

9 date.

10  SECTION 2. It being immediately necessary for the preservation

10

1 1 of the public peace, health or safety, an emergency is hereby

11

1 2 declared to exist, by reason whereof this act shall take effect and

12

1 3 be in full force from and after its passage and approval.
