7   An Act relating to road construction; prohibiting

7   liability of traffic control contractors and

8   subcontractors under certain circumstances; providing

8   for codification; and providing an effective date.

1 2 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.     NEW LAW  A new section of law to be codified

13

1 4 in the Oklahoma Statutes as Section 1239 of Title 69, unless there

14

1 5 is created a duplication in numbering, reads as follows:

15

16  A traffic control contractor or subcontractor who provides

16

1 7 traffic control services to the Department of Transportation shall

17

1 8 not be liable to a claimant for personal injury, property damage, or

18

1 9 death arising from the performance of the traffic control services

19

2 0 if, at the time of the personal injury, property damage, or death,

20

2 1 the traffic control contractor or subcontractor is in compliance

21

2 2 with all applicable safety regulations provided by the Department

22

2 3 related to the condition or defect that was the proximate cause of

23

2 4 the personal injury, property damage, or death.

1   SECTION 2. This act shall become effective November 1, 2025.
