7 An Act relating to public health and safety; amending
7 63 O.S. 2021, Section 1-1923, as amended by Section
8 1, Chapter 197, O.S.L. 2023 (63 O.S. Supp. 2024,
8 Section 1-1923), which relates to the Long-Term Care
9 Facility Advisory Council; extending sunset date;
9 updating statutory language; providing an effective
10 date; and declaring an emergency.

1 3 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
13
14 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-1923, as
14
1 5 amended by Section 1, Chapter 197, O.S.L. 2023 (63 O.S. Supp. 2024,
15
1 6 Section 1-1923), is amended to read as follows:
16
17 Section 1-1923. A. There is hereby re-created, to continue
17
1 8 until July 1, 2025 July 1, 2026, in accordance with the provisions
18
1 9 of the Oklahoma Sunset Law, a Long-Term Care Facility Advisory
19
2 0 Council which shall be composed as follows:
20
21 1. The Governor shall appoint a thirteen-member Long-Term Care
21
2 2 Facility Advisory Council which shall advise the State Commissioner
22
2 3 of Health. The Advisory Council shall be comprised of the following
23
2 4 persons:

1 a. one representative from the Oklahoma Health Care
1
2 Authority, designated by the Administrator,
2
3 b. one representative from the Department of Mental
3
4 Health and Substance Abuse Services, designated by the
4
5 Commissioner of Mental Health and Substance Abuse
5
6 Services,
6
7 c. one representative from the Department of Human
7
8 Services, designated by the Director of Human
8
9 Services,
9
10 d. one member who shall be a licensed general
10
11 practitioner of the medical or osteopathic profession,
11
12 e. one member who shall be a registered pharmacist,
12
13 f. one member who shall be a licensed registered nurse
13
14 Registered Nurse or licensed practical nurse Licensed
14
15 Practical Nurse,
15
16 g. one member who shall be an operator-administrator of a
16
17 nursing home which has a current license issued
17
18 pursuant to the Nursing Home Care Act and who shall
18
19 have had five (5) years' experience in the nursing
19
20 home profession as an operator-administrator,
20
21 h. one member who shall be an operator-administrator of a
21
22 residential care home licensed pursuant to the
22
23 provisions of the Residential Care Act,

1 i. one member who shall be an owner-operator of an adult
1
2 day care facility licensed pursuant to the provisions
2
3 of the Adult Day Care Act,
3
4 j. one member who shall be an owner-operator of a
4
5 continuum of care facility or assisted living center
5
6 licensed pursuant to the provisions of the Continuum
6
7 of Care and Assisted Living Act,
7
8 k. two members who shall be over the age of sixty-five
8
9 (65) who shall represent the general public and have
9
10 no long-term care professional work history, and
10
11 l. one member who shall be over the age of sixty-five
11
12 (65) who shall represent the general public and who
12
13 advocates for individuals receiving long-term care
13
14 services; and
14
15 2. Appointments shall be for two-year terms. Members shall
15
1 6 serve at the pleasure of their designators. Members may be
16
1 7 reappointed not to exceed two terms. In case of a vacancy, the
17
1 8 Governor shall appoint individuals to fill the remainder of the
18
1 9 term.
19
20 B. The State Department of Health shall provide administrative
20
2 1 support to perform designated duties of the Advisory Council. The
21
2 2 Department shall also provide space for meetings of the Advisory
22
2 3 Council.

1 C. The Advisory Council shall annually elect a chair, vice-
1
2 chair vice chair and secretary-treasurer, shall meet at least
2
3 quarterly, and may hold such special meetings as may be necessary.
3
4 The members of the Advisory Council shall be reimbursed as provided
4
5 for by the State Travel Reimbursement Act.
5
6 D. The Advisory Council shall have the power and duty to:
6
7 1. Serve as an advisory body to the Department for the
7
8 development and improvement of services to and care and treatment of
8
9 residents of facilities subject to the provisions of the Nursing
9
1 0 Home Care Act, homes subject to the provisions of the Residential
10
1 1 Care Act and facilities subject to the provisions of the Adult Day
11
1 2 Care Act;
12
13 2. Review and make recommendations regarding quality of
13
1 4 services, care, and treatment provided to individuals receiving
14
1 5 services from entities that are subject to the Nursing Home Care
15
1 6 Act, the Residential Care Act and the Adult Day Care Act; and
16
17 3. Evaluate and review the standards, practices, and procedures
17
1 8 regarding the administration and enforcement of the provisions of
18
1 9 the Nursing Home Care Act, the Residential Care Act and the Adult
19
2 0 Day Care Act.
20
21 SECTION 2. This act shall become effective July 1, 2025.
21
22 SECTION 3. It being immediately necessary for the preservation
22
2 3 of the public peace, health or safety, an emergency is hereby
23

1 declared to exist, by reason whereof this act shall take effect and
1
2 be in full force from and after its passage and approval.
