7 An Act relating to conveyances; amending 21 O.S.
7 2021, Section 1836, which relates to filing purported
8 conveyance without color of title; increasing maximum
8 fine for certain offense; increasing maximum
9 imprisonment for certain offense; allowing imposition
9 of fine and imprisonment; updating statutory
10 reference; and providing an effective date.

1 3 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. AMENDATORY 21 O.S. 2021, Section 1836, is
14
1 5 amended to read as follows:
15
16 Section 1836. Any person, firm or officer, representative, or
16
1 7 agent of any firm or corporation, who shall execute and deliver, or
17
1 8 who shall file for record or cause to be recorded in the office of
18
1 9 any county clerk of any county in this state, any deed or other
19
2 0 instrument in writing purporting to convey any right, title, or
20
2 1 interest, or right to possession in and to any real estate situated
21
2 2 in such county, to which the grantor, or grantors, therein did not
22
2 3 have and hold a bona fide color of title, and any such person who
23
2 4 shall file or cause to be filed for record in such office any such

1 deed or other instrument which clouds the title of any real estate
1
2 allotted to any member of one of the Five Civilized Tribes, or to
2
3 the Osage Tribe of Indians Nation, as a homestead, prior to the
3
4 removal of the restrictions thereon by operation of law, or
4
5 otherwise, knowing the land conveyed to be restricted homestead
5
6 lands, shall be deemed guilty of a misdemeanor, and, upon
6
7 conviction, shall be punished by a fine not to exceed One Hundred
7
8 Dollars ($100.00) Five Hundred Dollars ($500.00), and by
8
9 imprisonment in the county jail for a period not to exceed thirty
9
1 0 (30) days ninety (90) days, or by both such fine and imprisonment.

11 SECTION 2. This act shall become effective November 1, 2025.
