7   An Act relating to school employees; amending 70 O.S.

7   2021, Section 509.11, which relates to equal access

8   to employees of a school district; prohibiting a

8   school district from requiring or coercing school

9   district employees to take certain actions,

9   distributing certain communications or solicitations,

10  and permitting access to or use of certain activities

10  or equipment; providing an effective date; and

11  declaring an emergency.

1 4 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.     AMENDATORY        70 O.S. 2021, Section 509.11, is

15

1 6 amended to read as follows:

16

17  Section 509.11. A. No school district, employee of a school

17

1 8 district, or employee organization shall deny by any means,

18

1 9 including a collective bargaining agreement, a statewide

19

2 0 professional educators' association equal access to employees of the

20

2 1 school district, to the same extent that access is granted to other

21

2 2 educators' associations. For purposes of this section, access shall

22

2 3 include, but is not limited to:

1   1. Setting up informational tables at in-service or other

1

2 similar teacher meetings;

2

3   2. Speaking at in-service or other similar teacher meetings;

3

4   3. Distributing information in school mail boxes or through the

4

5 school e-mail system;

5

6   4. Utilizing school district meeting rooms during nonworking

6

7 hours;

7

8   5. Representing employees in employment matters, when requested

8

9 by the employee;

9

10  6. Posting information on school district bulletin boards; and

10

11  7. Utilizing school district printing services.

12  B. Any association which utilizes school district facilities or

12

1 3 services shall reimburse the district for any costs incurred by the

13

1 4 district.

15  C. A school district is prohibited from:

15

16  1. Requiring or coercing school district employees to meet,

16

1 7 communicate, listen to, or otherwise interact with an employee

17

1 8 organization or statewide professional educators' association;

18

19  2. Distributing communications or membership solicitations on

19

2 0 behalf of an employee organization or statewide professional

20

2 1 educators' association; and

21

22  3. Permitting an employee organization or statewide

22

2 3 professional educators' association access to or use of the school

23

2 4 district's meetings, events, facilities, communications systems,

1 computer systems, equipment, supplies, or other resources on terms

1

2 more favorable than extended to any other employee organization or

2

3 statewide professional educators' association seeking similar access

3

4 or use.

5   SECTION 2. This act shall become effective July 1, 2025.

5

6   SECTION 3. It being immediately necessary for the preservation

6

7 of the public peace, health, or safety, an emergency is hereby

7

8 declared to exist, by reason whereof this act shall take effect and

8

9 be in full force from and after its passage and approval.
