7 An Act relating to indigenous or traditional healing
7 therapies; defining terms; stating legislative
8 intent; granting certain protections to traditional
8 healing practitioners; prohibiting certain acts by
9 traditional healing practitioners; providing for
9 penalties; providing for codification; and providing
10 an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 732 of Title 59, unless there is
15
16 created a duplication in numbering, reads as follows:
16
17 A. As used in this section:
17
18 1. "Culture" means a way of life of a group of people
18
19 including, but not limited to, the behaviors, beliefs, values,
19
20 customs, traditional practices, art, music, rituals, or ceremonies
20
21 specific to a people;
21
22 2. "Indigenous or traditional healing therapy" means any
22
23 healing art, practice, ritual, ceremony, or modality that has been
23

1 historically performed or utilized by indigenous or native peoples

2 or traditional healing practitioners; and
2
3 3. "Traditional healing practitioner" means any individual with
3
4 a distinct culture, practice, belief, or healing system that is
4
5 practiced or performed to support wellness.
5
6 B. The Legislature intends, by its enactment of this section,
6
7 to protect and preserve by this state, unfettered public access to
7
8 all indigenous or traditional healing therapies and to protect and
8
9 preserve the right to practice and provide services according to
9
10 this section.
10
11 C. Notwithstanding any other state law or rule, a traditional
11
12 healing practitioner who does not hold a license, permit,
12
13 certification, or registration as a health care professional issued
13
14 by this state shall not be in violation of any health care
14
15 professional practice act or other law or rule if that individual or
15
16 agent provides care or treatment in compliance with subsection D of
16
17 this section and does not falsely represent himself or herself as a
17
18 licensed practitioner of medicine or other health care professional
18
19 as described in Title 59 of the Oklahoma Statutes, or fraudulently
19
20 use any title or degree appertaining to the licensed practice
20
21 thereof, or falsely claim any training, certification, or approval
21
22 of any organization that he or she does not have.

23 D. A traditional healing practitioner shall not:

24 1. Perform surgery, or any intravenous medical procedure;

1 2. Set fractures;

2 3. Prescribe or administer x-ray or gamma ray radiation, or any
2
3 other radiation field not inherent to the human body;
3
4 4. Prescribe or administer a prescription drug or device, or
4
5 any controlled substance;
5
6 5. Recommend interruption or elimination of prescribed
6
7 medications or treatments;
7
8 6. Conventionally diagnose a medical disease;
8
9 7. Move joints beyond their normal range of motion; or
9
10 8. State, advertise, or otherwise falsely represent to any
10
11 individual that the person is licensed by, certified by, or
11
12 registered with this state to practice as a health care
12
13 professional.
13
14 E. Any person who fails to comply with this section may, as
14
15 provided by law, be subject to administrative action by the
15
16 appropriate licensing board, criminal prosecution, civil liability,
16
17 or any other remedies provided by law.

18 SECTION 2. This act shall become effective November 1, 2025.
