7 An Act relating to railroad safety; defining terms;
7 requiring certain placement of hot bearings detector;
8 authorizing Department of Public Safety to issue
8 citations for certain violations; setting amount of
9 fines for certain violations; providing for
9 codification; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 104 of Title 66, unless there is
14
15 created a duplication in numbering, reads as follows:

16 A. As used in this section:

17 1. "Hot bearings detector" means an infrared detector located
17
18 along railroad tracks to detect and alert the operators of a passing
18
19 train to any overheating of the train's bearings, axles, or wheels;
19

21 2. "Main line" means a segment or route of railroad track of
21
22 any railroad over which five million (5,000,000) or more gross tons
22
23 of railroad traffic is transported annually as documented in
23
24 timetables filed with the Federal Railroad Administration. Main

1 line does not include tourist, scenic, historic, or excursion

2 operations.

3 B. Any person, firm, or corporation operating a train in this
3
4 state shall install and maintain a hot bearings detector system at
4
5 least every ten (10) miles along each main line.
5
6 C. The Department of Public Safety shall have the authority to
6
7 issue a citation to any person, firm, or corporation that violates
7
8 the provisions of this section. Such person, firm, or corporation
8
9 shall be subject to a fine not less than One Thousand Dollars
9
10 ($1,000.00) but not more than Five Thousand Dollars ($5,000.00).

11 SECTION 2. This act shall become effective November 1, 2025.
