7 An Act relating to railroads; defining term;
7 requiring physical copies of certain items to be
8 placed aboard trains; authorizing Department of
8 Public Safety to issue citations for certain
9 violations; setting amount of fines for certain
9 violations; providing for codification; and providing
10 an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 104 of Title 66, unless there is
15
16 created a duplication in numbering, reads as follows:

17 A. As used in this section, "Emergency Response Guidebook"
17
18 means the manual intended for use during the initial phase of a
18
19 transportation incident involving hazardous materials or dangerous
19
20 goods published by the United States Department of Transportation.
20
21 B. Any person, firm, or corporation operating a railroad train
21
22 in connection with carrying freight in this state shall be required
22
23 to maintain physical copies aboard each railroad train operated by
23
24 the person, firm, or corporation of:

1 1. The cargo manifest of the train;

2 2. The Emergency Response Guidebook; and
2
3 3. Identification cards that show the qualifications of each
3
4 member of the train crew aboard the train.

5 C. The Department of Public Safety may issue a citation to any
5
6 person, firm, or corporation that violates the provisions of this
6
7 section. Such person, firm, or corporation shall be subject to a
7
8 fine of:
8
9 1. Not less than Two Hundred Fifty Dollars ($250.00) but not
9
10 more than One Thousand Dollars ($1,000.00) for a first offense;
10
11 2. More than One Thousand Dollars ($1,000.00) but not to exceed
11
12 Five Thousand Dollars ($5,000.00) for a second offense committed
12
13 within three (3) years; or
13
14 3. More than Five Thousand Dollars ($5,000.00) but not to
14
15 exceed Ten Thousand Dollars ($10,000.00) for a third or subsequent
15
16 offense committed within three (3) years.

17 SECTION 2. This act shall become effective November 1, 2025.
