7   An Act relating to eminent domain; amending 27 O.S.

7   2021, Section 7, which relates to eminent domain for

8   light, heat, or power by electricity or gas;

8   clarifying applicability of provisions to certain

9   entities; prohibiting use of eminent domain for

9   certain facilities; requiring authorization by

10  Corporation Commission for exercise of eminent domain

10  by certain entities for specified purpose; and

11  declaring an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.     AMENDATORY   27 O.S. 2021, Section 7, is

15

16 amended to read as follows:
16

17  Section 7. A. Except as otherwise provided in this section,

17

18 any person, firm, or corporation organized under the laws of this
18

19 state, or authorized to do business in this state, to furnish light,
19

20 heat, or power by electricity or natural gas, or any other person,
20

21 association, or firm engaged in furnishing lights, heat, or power by
21

22 electricity or natural gas shall have and exercise the right of
22

23 eminent domain in the same manner and by like proceedings as
23

24 provided for railroad corporations by laws of this state.

1   B. The power of eminent domain shall not be used for the siting

2 or building of wind turbines energy facilities, solar energy
2

3 facilities, battery storage facilities, or hydrogen gas facilities
3

4 on private property.

5   C. Prior to seeking to exercise the right of eminent domain for

5

6 an electric transmission facility rated greater than three hundred
6

7 (300) kilovolts, any person, firm, or corporation subject to the
7

8 requirements of subsection A of this section shall have obtained a
8

9 certificate of authority from the Corporation Commission.
9

10  SECTION 2. It being immediately necessary for the preservation

10

11 of the public peace, health or safety, an emergency is hereby
11

12 declared to exist, by reason whereof this act shall take effect and
12

13 be in full force from and after its passage and approval.
