7   An Act relating to cities and towns; amending 11 O.S.

7   2021, Section 43-103, which relates to purpose of

8   regulations; restricting certain municipal powers;

8   updating statutory language; and providing an

9   effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.     AMENDATORY   11 O.S. 2021, Section 43-103, is

13

14 amended to read as follows:
14

15  Section 43-103. A. Municipal regulations as to buildings,

15

16 structures, and land shall be made in accordance with a
16

17 comprehensive plan and be designed to accomplish any of the
17

18 following objectives:
18

19  1. To lessen congestion in the streets;

19

20  2. To secure safety from fire, panic, and other dangers;

20

21  3. To promote health and the general welfare, including the

21

22 peace and quality of life of the district;

23  4. To provide adequate light and air;

23

24  5. To prevent the overcrowding of land;

1   6. To promote historical preservation;

2   7. To avoid undue concentration of population; or

2

3   8. To facilitate the adequate provision of transportation,

4 water, sewerage, schools, parks, and other public requirements.

5 The regulations shall be made with reasonable consideration, among
5

6 other things, as to the character of the district and its peculiar
6

7 suitability for particular uses, and with a view to conserving the
7

8 value of buildings and encouraging the most appropriate use of land
8

9 throughout the municipality. The governing body shall not implement
9

10 minimum parking requirements while implementing the provisions of
10

11 this section.

12  B. The governing body shall provide the manner in which

12

13 regulations, restrictions, and district boundaries shall be
13

14 determined, established, and enforced, and amended, supplemented, or
14

15 changed.
15

16  SECTION 2. This act shall become effective November 1, 2025.
