6   An Act relating to absentee ballots; establishing

6   alternative procedures for execution of certain

7   absentee ballot affidavits; amending 26 O.S. 2021,

7   Section 14-133, which relates to notification of

8   rejection; updating statutory language; requiring

8   opportunity to cure certain defective application or

9   affidavit; modifying certain notice requirement;

9   requiring Secretary of the State Election Board to

10  promulgate certain rules and procedures; repealing 26

10  O.S. 2021, Section 14-115.7, which relates to

11  applicable procedure for properly executing an

11  absentee ballot affidavit; providing for

12  codification; and providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14

15  SECTION 1.     NEW LAW       A new section of law to be codified

15

16 in the Oklahoma Statutes as Section 14-115.8 of Title 26, unless
16

17 there is created a duplication in numbering, reads as follows:
17

18  A. A voter who requests an absentee ballot pursuant to Section

18

19 14-105 of Title 26 of the Oklahoma Statutes may, in lieu of having
19

20 his or her signature notarized by a notary public as required by
20

21 Section 14-108 of Title 26 of the Oklahoma Statutes, sign the
21

22 absentee ballot affidavit and attach a photocopy of a form of
22

23 identification described in subsection A of Section 7-114 of Title
23

24 26 of the Oklahoma Statutes.

1   B. A voter who requests an absentee ballot described pursuant

2 to Section 14-110.1 or Section 14-114 of Title 26 of the Oklahoma
2

3 Statutes may, in lieu of having his or her signature witnessed by
3

4 two witnesses, sign the absentee ballot affidavit and include a
4

5 photocopy of a form of identification described in subsection A of
5

6 Section 7-114 of Title 26 of the Oklahoma Statutes.

7   SECTION 2.       AMENDATORY  26 O.S. 2021, Section 14-133, is

7

8 amended to read as follows:
8

9   Section 14-133. A. In the event a voter's application or

9

10 affidavit is rejected for any reason, the secretary of the county
10

11 election board shall immediately notify said the voter in writing by
11

12 mail or electronically of the rejection and the reason therefor for
12

13 the rejection, pursuant to the rules promulgated by the Secretary of
13

14 the State Election Board.

15  B. A voter receiving notice as described in subsection A of

15

16 this section shall be given the opportunity to cure the defective
16

17 application or affidavit pursuant to rules and procedures
17

18 promulgated by the Secretary of the State Election Board.

19  SECTION 3.       REPEALER    26 O.S. 2021, Section 14-115.7, is

19

20 hereby repealed.

21  SECTION 4. This act shall become effective November 1, 2025.
