7 An Act relating to the Department of Environmental
7 Quality; establishing moratorium on land application
8 of certain materials; prohibiting issuance or renewal
8 of certain permits; defining terms; providing for
9 codification; and declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 2-6-501.7 of Title 27A, unless
14
15 there is created a duplication in numbering, reads as follows:

16 A. To protect the health and safety of the people of Oklahoma,
16
17 a moratorium is hereby established on land application of sludge and
17
18 biosolid material in this state until July 1, 2028. On and after
18
19 the effective date of this act, the Department of Environmental
19
20 Quality shall not issue or renew any permit for the land application
20
21 of sludge or biosolid material and all active permits shall be
21
22 revoked until July 1, 2028.

23 B. For the purposes of this section:

1 1. "Biosolid material" means sludge, perfluoroalkyl, and any
1
2 polyfluoroalkyl substance; and
2
3 2. "Sludge" shall mean sludge as defined pursuant to Section 2-
3
4 10-401 of Title 27A of the Oklahoma Statutes.

5 SECTION 2. It being immediately necessary for the preservation
5
6 of the public peace, health or safety, an emergency is hereby
6
7 declared to exist, by reason whereof this act shall take effect and
7
8 be in full force from and after its passage and approval.
