7   An Act relating to wildlife; creating the Feral Swine

7   Eradication and Control Grant Program; stating

8   purpose of program; stating eligibility for grants;

8   authorizing the Oklahoma Department of Agriculture,

9   Food, and Forestry to implement certain program;

9   requiring collaboration from other Oklahoma entities;

10  setting maximum funds; stating use of funds;

10  providing for indemnity of the Department from

11  damages resulting from implementation of this

11  program; exempting indemnity from certain issues;

12  providing for the promulgation of rules; allowing the

12  Department to provide exemptions from certain

13  permitting; providing for codification; and providing

13  an effective date.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

17  SECTION 1.     NEW LAW  A new section of law to be codified

17

18 in the Oklahoma Statutes as Section 6-615 of Title 2, unless there
18

19 is created a duplication in numbering, reads as follows:

20  A. There is hereby created the Feral Swine Eradication and

20

21 Control Grant Program. The purpose of the grant program shall be to
21

22 provide Oklahomans with education, equipment, and services
22

23 associated with the eradication and control of feral swine in
23

24 Oklahoma.

1   B. The Oklahoma Department of Agriculture, Food, and Forestry

2 shall, through collaboration with the Department of Wildlife
2

3 Conservation and the Oklahoma Conservation Commission, implement a
3

4 program or programs for the distribution of resources to assist with
4

5 the capture or deterrence of feral swine populations affecting
5

6 Oklahoma landowners or land lessors.
6

7   C. The total maximum grant fund shall be no more than Five

7

8 Hundred Thousand Dollars ($500,000.00). The funds shall be derived
8

9 from legislative appropriations and other public and private sources
9

10 of monies including other grants and matching funds received by this
10

11 state from federal sources. The grants awarded through the Feral
11

12 Swine Eradication and Control Grant Program shall only be available
12

13 for the equipment, education, and services provided to Oklahomans
13

14 for the eradication of feral swine.
14

15  D. The Oklahoma Department of Agriculture, Food, and Forestry,

15

16 or any employee or agent of the Department shall not be liable for
16

17 damages in any civil suit or subject to criminal prosecution for any
17

18 injury resulting from the program, unless the injury or death is a
18

19 direct result of the gross negligence, recklessness, or intentional
19

20 misconduct of the Department or any employee or agent of the
20

21 Department.

22  E. The Oklahoma Department of Agriculture, Food, and Forestry

22

23 shall promulgate the rules necessary for the implementation of this
23

24 program along with any educational material necessary for the proper

1 eradication of feral swine for the landowners and land lessors
1

2 through this program as not to violate the provisions of subsection
2

3 D of this section. The Department may allow exemptions for
3

4 landowners and land lessors participating in this program from the
4

5 permits required to control nuisance and invasive species set forth
5

6 in Title 29 of the Oklahoma Statutes.
6

7   SECTION 2. This act shall become effective November 1, 2025.
