7   An Act relating to the state Medicaid program;

7   amending 63 O.S. 2021, Section 5060, which relates to

8   contracts with out-of-state providers; creating

8   exception to certain prohibition; updating statutory

9   language; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.     AMENDATORY   63 O.S. 2021, Section 5060, is

13

14 amended to read as follows:
14

15  Section 5060. A. Where practicable and in accordance with

15

16 state and federal law, and except as provided by subsection B of
16

17 this section, the state Medicaid program shall not contract with an
17

18 out-of-state medical provider for treatment that is available from
18

19 one or more providers licensed and practicing in the State of
19

20 Oklahoma this state.

21  B. Laboratory analysis or diagnostic processing services that

21

22 are not directly offered by a provider licensed and practicing in
22

23 this state may be reimbursed to an out-of-state laboratory for that
23

24 service only.

1   C. The Oklahoma Health Care Authority shall seek any federal

2 approval necessary to implement the provisions of this section.

3   SECTION 2. This act shall become effective November 1, 2025.
