8   An Act relating to tourism; amending 74 O.S. 2021,

8   Section 2251, which relates to the Oklahoma Tourism

9   and Recreation Department Revolving Fund; modifying

9   designation of funds from monies derived from certain

10  sales; updating statutory references; updating

10  statutory language; and providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.     AMENDATORY    74 O.S. 2021, Section 2251, is

15

16 amended to read as follows:
16

17  Section 2251. A. There is hereby created in the State Treasury

17

18 a revolving fund for the Oklahoma Tourism and Recreation Department
18

19 to be designated the "Oklahoma Tourism and Recreation Department
19

20 Revolving Fund". The fund shall be a continuing fund, not subject
20

21 to fiscal year limitations, and shall be under the administrative
21

22 direction of the Department.

23  B. The fund shall consist of all monies received:

1   1. Monies received by the Department pursuant to the provisions

2 of this act, monies the Oklahoma Tourism, Parks and Recreation
2

3 Enhancement Act;
3

4   2. Monies derived from the sale, transfer, lease, or other

4

5 conveyance of real property under the jurisdiction of the Oklahoma
5

6 Tourism and Recreation Commission, except those leases entered into
6

7 pursuant to a concessionaire agreement; and interest
7

8   3. Interest attributable to investment of money in the fund.

9 The revolving fund shall be a continuing fund not subject to fiscal
9

10 year limitations and shall be under the administrative direction of
10

11 the Department. Expenditures
11

12  C. All monies accruing to the fund from the sale, transfer,

12

13 lease, or other conveyance of the real property under paragraph 2 of
13

14 subsection B of this section shall be appropriated for maintenance
14

15 and capital projects of the state parks; provided, that these funds
15

16 shall not be expended for any compensation of any employee of any
16

17 state agency. All other expenditures from the fund created by this
17

18 section shall be for the administration, operation, and maintenance
18

19 expenses of the Department, and for purchase of real property, and
19

20 shall be made pursuant to the laws of this state and the statutes
20

21 relating to the Department. Expenditures from said the fund shall
21

22 be made pursuant to the laws of this state and statutes relating to
22

23 the Department and shall be made upon warrants issued by the State
23

24 Treasurer against claims filed as prescribed by law with the

1 Director of the Office of Management and Enterprise Services for

2 approval and payment.

3   SECTION 2. This act shall become effective November 1, 2025.
