8 An Act relating to alcoholic beverage licenses;
8 amending 37A O.S. 2021, Section 2-115, which relates
9 to special event licenses; requiring certain
9 applicant to hold certain liability insurance;
10 requiring certain individual to ensure licensure of
10 certain event; updating statutory language; and
11 providing an effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. AMENDATORY 37A O.S. 2021, Section 2-115, is
16
17 amended to read as follows:
17
18 Section 2-115. A. A special event license may be issued to an
18
19 organization, association, or nonprofit corporation organized for
19
20 political, fraternal, charitable, religious, or social purposes.
20
21 The holder of a special event license is authorized to sell and
21
22 distribute alcoholic beverage beverages on the premises for which
22
23 the license is issued.

1 B. The ABLE Alcoholic Beverage Laws Enforcement (ABLE)

2 Commission shall promulgate rules governing the application for and
2
3 the issuance of special event licenses. Such application shall
3
4 require the applicant to hold general liability insurance, including
4
5 liquor liability coverage, in an amount not less than One Million
5
6 Dollars ($1,000,000.00) per occurrence and Two Million Dollars
6
7 ($2,000,000.00) aggregate.

8 C. The restrictions and rules which apply to the sale of mixed
8
9 beverages on the premises of a mixed beverage licensee also apply to
9
10 the sale of such beverages under the authority of a special event
10
11 license. Any act which if done on the premises of a mixed beverage
11
12 licensee would be a ground for revocation or suspension of the mixed
12
13 beverage license is a ground for revocation or suspension of a
13
14 special event license.

15 D. No special event license may be issued for any premises
15
16 already licensed by the ABLE Commission.

17 E. No special event license shall be required for an
17
18 organization, association, or nonprofit corporation which is an
18
19 economic development chamber or similar entity, provided the event
19
20 is not conducted primarily for fundraising purposes, and provided
20
21 the services of a licensed caterer are used to provide and
21
22 distribute the alcoholic beverages at the event.

1 F. An individual holding an employee license who is serving any
1
2 alcoholic beverage at a special event shall ensure that such event
2
3 has been properly licensed.
3
4 SECTION 2. This act shall become effective November 1, 2026.
