7 An Act relating to agriculture; creating Kenny's Law;
7 providing short title; defining terms; requiring
8 gates to remain closed at all times; allowing for
8 certain exceptions; providing for violations of this
9 act; prescribing penalties for violation; requiring
9 promulgation of rules; providing for noncodification;
10 providing for codification; and providing an
10 effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law not to be
14
15 codified in the Oklahoma Statutes reads as follows:
15
16 This act shall be known and may be cited as "Kenny's Law".
16
17 SECTION 2. NEW LAW A new section of law to be codified
17
18 in the Oklahoma Statutes as Section 2-35 of Title 2, unless there is
18
19 created a duplication in numbering, reads as follows:

20 A. As used in this act:
20
21 1. "Gate" means a hinged, sliding, or otherwise movable barrier
21
22 used to control entry or exit through an opening in an enclosure,
22
23 fence, or wall;

1 2. "Livestock" means the same as defined in Section 1-3 of
1
2 Title 2 of the Oklahoma Statutes; and
2
3 3. "Maintenance" means the functional checking, servicing,
3
4 repairing, or replacing of necessary infrastructure conducted by the
4
5 property owner, utility company, municipality, or state or federal
5
6 agency.

7 B. All gates that are part of an enclosure or barrier designed
7
8 to contain livestock shall remain closed at all times, except when:
8
9 1. Ingress or egress is in progress; provided, that the ingress
9
10 or egress shall be reasonable and not prolonged as to allow persons
10
11 to enter and leave without causing containment of livestock to be
11
12 compromised;
12
13 2. Maintenance is occurring within the property;
13
14 3. Livestock are being moved from one area to another; or
14
15 4. The livestock owner, utility company, municipality, or any
15
16 state or federal agency has a functional reason to access the
16
17 enclosed area.

18 C. A person shall be in violation of this act if he or she
18
19 knowingly or maliciously:
19
20 1. Leaves a gate open that is part of an enclosure or barrier
20
21 designed to contain livestock on private or public property;
21
22 2. Damages any part of the gate that is part of an enclosure or
22
23 barrier designed to contain livestock, which compromises the
23
24 containment of livestock; or

1 3. Allows livestock to escape containment.

2 D. A person who violates the provisions of this act shall be
2
3 deemed guilty of a misdemeanor and, upon conviction, shall be
3
4 punishable by a fine not to exceed One Thousand Dollars ($1,000.00)
4
5 for each separate offense, imprisonment in a county jail for not
5
6 more than one hundred eighty (180) days for each separate offense,
6
7 or by both such fine and imprisonment, for the first and second
7
8 convictions. Third and subsequent convictions shall be punishable
8
9 by a fine not to exceed Two Thousand Five Hundred Dollars
9
10 ($2,500.00) for each separate offense, imprisonment in a county jail
10
11 for not more than one (1) year for each separate offense, or by both
11
12 such fine and imprisonment. A person who violates the provisions of
12
13 this section shall also incur all financial liability for damages
13
14 caused by the violation.

15 E. The State Board of Agriculture shall promulgate rules
15
16 necessary to implement the provisions of this act.

17 SECTION 3. This act shall become effective November 1, 2026.
