7   An Act relating to the Oklahoma Open Meeting Act;

7   amending 25 O.S. 2021, Section 304, as last amended

8   by Section 2, Chapter 369, O.S.L. 2025 (25 O.S. Supp.

8   2025, Section 304), which relates to definitions;

9   modifying definition; repealing 25 O.S. 2021, Section

9   309, which relates to the Legislature; and providing

10  an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
13

14  SECTION 1.      AMENDATORY  25 O.S. 2021, Section 304, as last

14

15 amended by Section 2, Chapter 369, O.S.L. 2025 (25 O.S. Supp. 2025,
15

16 Section 304), is amended to read as follows:
16

17  Section 304. As used in the Oklahoma Open Meeting Act:

17

18  1. "Public body" means the governing bodies of all

18

19 municipalities located within this state, the Legislature, boards of
19

20 county commissioners of the counties in this state, boards of public
20

21 and higher education in this state, and all boards, bureaus,
21

22 commissions, agencies, trusteeships, authorities, councils,
22

23 committees, public trusts, or any entity created by a public trust
23

24 including any committee or subcommittee composed of any of the
24

1 members of a public trust or other legal entity receiving funds from
1

2 the Rural Economic Action Plan Fund as authorized by Section 2007 of
2

3 Title 62 of the Oklahoma Statutes, task forces or study groups in
3

4 this state supported in whole or in part by public funds or
4

5 entrusted with the expending of public funds, or administering
5

6 public property, and shall include all committees or subcommittees
6

7 of any public body. Public body shall not include:
7

8   a. the state judiciary,

8

9   b. the Council on Judicial Complaints when conducting,

9

10                 discussing, or deliberating any matter relating to a

10

11                 complaint received or filed with the Council,

11

12  c. the Legislature,

12

13  d. administrative staffs of public bodies including, but

13

14                 not limited to, faculty meetings and athletic staff

14

15                 meetings of institutions of higher education when

15

16                 those staffs are not meeting with the public body, or

16

17                 entry-year assistance committees,

17

18  e. d. multidisciplinary teams provided for in Section 1-9-

18

19                 102 of Title 10A of the Oklahoma Statutes, in Section

19

20                 10-115 of Title 43A of the Oklahoma Statutes, and in

20

21                 subsection C of Section 1-502.2 of Title 63 of the

21

22                 Oklahoma Statutes or any school board meeting for the

22

23                 sole purpose of considering recommendations of a

23

1                  multidisciplinary team and deciding the placement of

2                  any child who is the subject of the recommendations,

2

3   f. e. meetings conducted by stewards designated by the

3

4                  Oklahoma Horse Racing Commission pursuant to Section

4

5                  203.4 of Title 3A of the Oklahoma Statutes when the

5

6                  stewards are officiating at races or otherwise

6

7                  enforcing rules of the Commission,

7

8   g. f. the board of directors of a Federally Qualified

8

9                  Health Center or the postadjudication review boards

9

10                 provided for in Sections 1116.2 and 1116.3 of Title 10

10

11                 of the Oklahoma Statutes, or

11

12  h. g. boards of county commissioners for the purposes set

12

13                 forth in subsections C, D, and E of Section 326 of

13

14                 Title 19 of the Oklahoma Statutes;

14

15  2. "Meeting" means the conduct of business of a public body by

15

16 a majority of its members being personally together or, as
16

17 authorized by Section 307.1 of this title, together pursuant to a
17

18 videoconference. Meeting shall not include informal gatherings of a
18

19 majority of the members of the public body when no business of the
19

20 public body is discussed;

21  3. "Regularly scheduled meeting" means a meeting at which the

21

22 regular business of the public body is conducted;
22

23  4. "Special meeting" means any meeting of a public body other

23

24 than a regularly scheduled meeting or emergency meeting;

1       5. "Emergency meeting" means any meeting called for the purpose

1

2 of dealing with an emergency. For purposes of the Oklahoma Open
2

3 Meeting Act, an emergency is defined as a situation involving injury
3

4 to persons or injury and damage to public or personal property or
4

5 immediate financial loss when the time requirements for public
5

6 notice of a special meeting would make such procedure impractical
6

7 and increase the likelihood of injury or damage or immediate
7

8 financial loss;
8

9       6. "Continued or reconvened meeting" means a meeting which is

9

10 assembled for the purpose of finishing business appearing on an
10

11 agenda of a previous meeting. For the purposes of the Oklahoma Open
11

12 Meeting Act, only matters on the agenda of the previous meeting at
12

13 which the announcement of the continuance is made may be discussed
13

14 at a continued or reconvened meeting;
14

15      7. "Videoconference" means a conference among members of a

15

16 public body remote from one another who are linked by interactive
16

17 telecommunication devices or technology, or technology permitting
17

18 both visual and auditory communication between and among members of
18

19 the public body or between and among members of the public body and
19

20 members of the public. During any videoconference, both the visual
20

21 and auditory communications functions shall attempt to be utilized;

22 and
22

23      8. "Teleconference" means a conference among members of a

23

24 public body remote from one another who are linked by

1 telecommunication devices or technology permitting auditory
1

2 communication between and among members of the public body or
2

3 between and among members of the public body and members of the
3

4 public.
4

5   SECTION 2.     REPEALER  25 O.S. 2021, Section 309, is hereby

5

6 repealed.
6

7   SECTION 3. This act shall become effective November 1, 2026.
