7 An Act relating to the Legislature; defining terms;
7 permitting legislative committees to issue subpoenas;
8 providing process to issue subpoenas; providing for
8 penalties; providing for exceptions; providing for
9 codification; and declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 12011 of Title 74, unless there
14
15 is created a duplication in numbering, reads as follows:

16 A. As used in this section:
16
17 1. "Legislative committee" means any standing committee,
17
18 interim committee, select committee, subcommittee, or joint
18
19 committee of the Legislature duly authorized to conduct
19
20 investigations or oversight;

21 2. "Majority vote" means a vote in favor by more than fifty
21
22 percent (50%) of the total membership of the committee, excluding ex
22
23 officio members in the committee membership total unless they are
23
24 present and voting; and

1 3. "Subpoena" means a subpoena for the attendance of witnesses

2 or the production of documents, records, or other evidence.

3 B. In addition to the powers granted under Section 42 of
3
4 Article V of the Oklahoma Constitution, any legislative committee
4
5 shall have the power to issue subpoenas in furtherance of its
5
6 authorized investigative or oversight functions. A subpoena may be
6
7 authorized:

8 1. Upon a majority vote of the committee at any duly convened
8
9 meeting where a quorum is present. Upon authorization by majority
9
10 vote, the chair of the committee, or the vice chair in the absence
10
11 of the chair, shall issue and sign the subpoena on behalf of the
11
12 committee; or

13 2. Jointly by the chair and vice chair of the committee. Upon
13
14 joint authorization by the chair and vice chair, either the chair or
14
15 vice chair may issue and sign the subpoena.

16 C. Any rule of the Senate or House of Representatives in
16
17 conflict with the provisions of this section is hereby superseded to
17
18 the extent of such conflict.

19 D. Disobedience of a subpoena issued pursuant to this section,
19
20 or disorderly conduct in relation thereto, shall constitute contempt
20
21 punishable as provided in Section 42 of Article V of the Oklahoma
21
22 Constitution.

1 E. This section shall not limit the inherent powers of either
1
2 house of the Legislature or any other statutory authority related to
2
3 legislative investigations.

4 SECTION 2. It being immediately necessary for the preservation
4
5 of the public peace, health or safety, an emergency is hereby
5
6 declared to exist, by reason whereof this act shall take effect and
6
7 be in full force from and after its passage and approval.
