7 An Act relating to animals; amending 4 O.S. 2021,
7 Sections 30.2, 30.5, and 30.7, which relate to the
8 Commercial Pet Breeders and Animal Shelter Licensing
8 Act; modifying definitions; modifying application and
9 inspection requirements for certain licensure;
9 requiring promulgation of rules; modifying
10 requirements for certain license suspension or
10 revocation; updating statutory language; and
11 providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. AMENDATORY 4 O.S. 2021, Section 30.2, is
15
16 amended to read as follows:
16
17 Section 30.2. As used in the Commercial Pet Breeders and Animal
17
18 Shelter Licensing Act:
18
19 1. "Adult animal" means an intact female animal twelve (12)
19
20 nine (9) months of age or older;
20
21 2. "Animal" means a dog or a cat, including a puppy or kitten;
21
22 3. "Animal shelter" means any nongovernmental facility that
22
23 maintains ten or more dogs and cats operated by or under contract
23
24 for the state, a county, a municipal corporation, or any other

1 political subdivision of the state for the purpose of impounding or
1
2 harboring seized, stray, homeless, abandoned or unwanted dogs or
2
3 cats; and any facility that maintains ten or more dogs and cats
3
4 operated, owned, or maintained by any person or organization for
4
5 such purpose, but not including any facility that does not house or
5
6 harbor dogs or cats on the premises and only operates through a
6
7 system of fostering in private homes;

8 4. "Animal shelter operator" means any individual, entity,
8
9 association, trust, or corporation that operates a nongovernmental
9
10 facility that maintains ten or more dogs and cats for the purpose of
10
11 impounding or harboring seized, stray, homeless, abandoned or
11
12 unwanted dogs or cats, but not including any facility that does not
12
13 house or harbor dogs or cats on the premises and only operates
13
14 through a system of fostering in private homes;

15 5. "Board" means the State Board of Agriculture;
15
16 6. "Cat" means a mammal that is wholly or partly of the species
16
17 Felis domesticus;
17
18 7. "Commercial breeder" and "commercial pet breeder" mean any
18
19 individual, entity, association, trust, or corporation who possesses
19
20 eleven or more intact female animals for the use of breeding or
20
21 dealing in animals for direct or indirect sale or for exchange in
21
22 return for consideration;

1 8. "Commercial pet breeder license" means a license issued to
1
2 any person that qualifies and is licensed as a commercial pet
2
3 breeder;
3
4 9. "Animal shelter license" means a license issued to any
4
5 applicant that qualifies and is licensed as an animal shelter
5
6 operator;
6
7 10. "Department" means the Oklahoma Department of Agriculture,
7
8 Food, and Forestry;
8
9 11. "Dog" means a mammal that is wholly or partly of the
9
10 species Canis familiaris;
10
11 12. "Facility" means the premises used by one or more animal
11
12 shelter operators or commercial breeders. The term includes all
12
13 buildings, property, and confinement areas in a single location used
13
14 to conduct the animal shelter or commercial breeding business;
14
15 13. "Family member" means the parent, spouse, child, or sibling
15
16 of an individual;
16
17 14. "Humane society" means a nonprofit organization exempt from
17
18 federal income taxation as an organization described in Section
18
19 501(c)(3), Internal Revenue Code of 1986, as amended, that has as a
19
20 principal purpose the prevention of animal cruelty or the sheltering
20
21 of, caring for, and providing of homes for lost, stray, and
21
22 abandoned animals;

1 15. "Inspector" means an authorized agent of the Board or any
1
2 other qualified person authorized by the Department to conduct
2
3 inspections;
3
4 16. "Intact female animal" means a female animal, nine (9)
4
5 months of age or older, and not spayed;
5
6 17. "Kitten" means a cat less than twelve (12) nine (9) months
6
7 old;
7
8 18. "Local animal control authority" means a municipal or
8
9 county animal control office with authority over the premises in
9
10 which an animal is kept or, in an area that does not have an animal
10
11 control office, the county sheriff;
11
12 19. "Marketing" means the solicitation for sale of animals;
12
13 20. "Noncommercial breeder" means any individual, entity,
13
14 association, trust, or corporation who possesses ten or fewer intact
14
15 female animals for the use of breeding or dealing in animals for
15
16 direct or indirect sale or for exchange in return for consideration;
16
17 21. "Person" means any individual, association, trust,
17
18 corporation, limited liability company, partnership, or other
18
19 entity;
19
20 22. "Pet" means a dog or cat, including a puppy or kitten, that
20
21 is privately owned and not available for adoption, sale, or transfer
21
22 of any kind;

23 23. "Possess" means to have custody of or control over, but
23
24 shall not include custody or control over an animal by a person who

1 is not a resident of this state and is in this state for the sole
1
2 purpose of attending a competitive show or event held in this state;
2
3 24. "Puppy" means a dog less than twelve (12) nine (9) months
3
4 old; and
4
5 25. "Veterinarian" means a person currently licensed to
5
6 practice veterinary medicine in Oklahoma this state.
6
7 SECTION 2. AMENDATORY 4 O.S. 2021, Section 30.5, is
7
8 amended to read as follows:
8
9 Section 30.5. A. The Oklahoma Department of Agriculture, Food,
9
10 and Forestry may contract with a local veterinarian licensed by the
10
11 state, other state agency, or any other qualified person to conduct
11
12 or assist in an initial prelicense inspection and annual
12
13 inspections.
13
14 B. The Department shall arrange for an a prelicense inspection
14
15 at a facility prior to issuance of an initial animal shelter or
15
16 commercial pet breeder license for that facility.
16
17 1. The Department shall not issue an animal shelter or
17
18 commercial pet breeder license to any person until the Department
18
19 receives an initial prelicense inspection report from the inspector
19
20 in a format approved by the Department certifying that the facility
20
21 meets the requirements of the Commercial Pet Breeders and Animal
21
22 Shelter Licensing Act.
22
23 2. Prior to the initial prelicense inspection, each applicant
23
24 shall pay to the Department a nonrefundable inspection fee.

1 C. The Department, at least annually, shall arrange for the
1
2 inspection of each facility of a licensed animal shelter operator or
2
3 commercial breeder. The inspection shall be conducted during normal
3
4 business hours and the animal shelter operator, commercial breeder
4
5 or a representative of the facility shall be present during the
5
6 inspection The Board shall promulgate rules as necessary to conduct
6
7 at a minimum an annual inspection at each animal shelter or
7
8 commercial breeder to administer the Commercial Pet Breeders and
8
9 Animal Shelter Licensing Act.
9
10 D. The inspector shall submit an inspection report to the
10
11 Department not later than ten (10) days after the date of the
11
12 inspection on a form prescribed by the Department and provide a copy
12
13 of the report to the animal shelter operator, commercial breeder, or
13
14 the representative.
14
15 E. On receipt of a valid written complaint alleging a violation
15
16 of the Commercial Pet Breeders and Animal Shelter Licensing Act, an
16
17 authorized agent of the State Board of Agriculture, a local animal
17
18 control authority, or an inspector designated by the Department may
18
19 investigate the alleged violation.
19
20 F. The Department shall not hire any humane society group or
20
21 member of any humane society group to perform any inspection
21
22 required by the Commercial Pet Breeders and Animal Shelter Licensing
22
23 Act.

1 SECTION 3. AMENDATORY 4 O.S. 2021, Section 30.7, is
1
2 amended to read as follows:
2
3 Section 30.7. The Oklahoma Department of Agriculture, Food, and
3
4 Forestry may deny a license, or renewal thereof, or revoke a license
4
5 of any applicant, animal shelter operator, or commercial pet breeder
5
6 who fails to meet the standards of animal care or fails to follow
6
7 the application process adopted by the Department, or if the person
7
8 any owner, operator, partner, or member with percentage ownership:
8
9 1. Is convicted of a crime involving animal cruelty;
9
10 2. Is convicted of violating the Commercial Pet Breeders and
10
11 Animal Shelter Licensing Act more than three times;
11
12 3. Is convicted of a type of felony specified by subparagraphs
12
13 a through pp of paragraph 2 of Section 571 of Title 57 of the
13
14 Oklahoma Statutes;
14
15 4. Is convicted of a felony punishable under the Oklahoma
15
16 Racketeer-Influenced and Corrupt Organizations Act; or
16
17 5. Has held or applied for a United States Department of
17
18 Agriculture license pursuant to the federal Animal Welfare Act and
18
19 whose license was suspended or revoked, or whose application was
19
20 refused due to the improper care of animals.
20
21 SECTION 4. This act shall become effective November 1, 2026.
