7   An Act relating to agriculture; defining terms;

7   providing for the State Board of Agriculture to

8   promulgate rules; requiring Oklahoma Department of

8   Agriculture, Food, and Forestry to provide certain

9   guidance to certain county organizations; defining

9   terms; requiring wreckers to take certain action in

10  certain circumstance; requiring certain county

10  organization to provide certain assistance; providing

11  for codification; and providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.      NEW LAW  A new section of law to be codified

15

16 in the Oklahoma Statutes as Section 2-35 of Title 2, unless there is
16

17 created a duplication in numbering, reads as follows:
17

18  A. As used in this section:

18

19  1. "Livestock" means cattle, swine, sheep, horses, mules,

19

20 domesticated rabbits, asses, or goats; and
20

21  2. "Poultry" means chickens, turkeys, ducks, geese, or any

21

22 other domesticated bird used for human food or animal feed.

1   B. The State Board of Agriculture shall promulgate rules

2 regarding the humane treatment of livestock and poultry involved in
2

3 vehicular accidents.
3

4   C. The Oklahoma Department of Agriculture, Food, and Forestry

4

5 shall provide guidance and recommendations to county emergency
5

6 management organizations in the humane treatment and disposition of
6

7 such livestock and poultry, as provided in Section 2 of this act.

8   SECTION 2.     NEW LAW  A new section of law to be codified

8

9 in the Oklahoma Statutes as Section 955.1 of Title 47, unless there
9

10 is created a duplication in numbering, reads as follows:

11  A. As used in this section:

11

12  1. "Livestock" means cattle, swine, sheep, horses, mules,

12

13 domesticated rabbits, asses, or goats; and
13

14  2. "Poultry" means chickens, turkeys, ducks, geese, or any

14

15 other domesticated bird used for human food or animal feed.

16  B. Any wrecker or towing service that responds to the scene of

16

17 an accident involving livestock or poultry shall, upon being made
17

18 aware of such involvement, immediately contact the emergency
18

19 management organization of the county wherein such accident
19

20 occurred. The emergency management organization shall assist with
20

21 the humane treatment and disposition of such livestock and poultry
21

22 involved in the accident, in accordance with the promulgated rules
22

23 and guidance of the Oklahoma Department of Agriculture, Food, and
23

24 Forestry, as provided in Section 1 of this act.

1   SECTION 3. This act shall become effective November 1, 2026.
