7 An Act relating to agriculture; amending 2 O.S. 2021,
7 Section 7-414, which relates to the Oklahoma Milk and
8 Milk Products Act; exempting certain sales; allowing
8 for advertising; increasing average monthly yield for
9 incidental sales; authorizing the sale of ungraded
9 raw milk or ungraded raw milk products; allowing for
10 off-premises sales; requiring certain labels be added
10 upon sale; repealing 2 O.S. 2021, Section 7-417,
11 which relates to required permit for ungraded raw
11 milk or milk products; providing for codification;
12 and declaring an emergency.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

17 SECTION 1. AMENDATORY 2 O.S. 2021, Section 7-414, is
17
18 amended to read as follows:
18
19 Section 7-414. A. The provisions of the Oklahoma Milk and Milk
19
20 Products Act shall not be construed to:
20
21 1. Include incidental sales of ungraded raw milk and raw milk
21
22 products directly to consumers:
22
23 a. at the farm where the ungraded raw milk or raw milk
23
24 product is produced, or

1 b. by transport by the farmer or producer of ungraded raw

2 milk or raw milk products pursuant to subsection B of
2
3 Section 2 of this act;

4 2. Preclude the advertising of the incidental sale of goat
4
5 milk; and
5
6 3. Preclude the advertising of the sale of ungraded raw milk
6
7 and raw milk products; and
7
8 4. Prohibit any farmer or producer from making cheese using
8
9 milk or cream produced on the farm of such farmer or producer.
9
10 B. For purposes of this section, incidental sales of goat milk
10
11 or milk products are those sales where the average monthly number of
11
12 gallons sold does not exceed one hundred (100) one thousand five
12
13 hundred (1,500).

14 SECTION 2. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 7-422 of Title 2, unless there
15
16 is created a duplication in numbering, reads as follows:

17 A. Any farmer or producer selling, offering, or exposing for
17
18 sale ungraded raw milk or raw milk products from his or her
18
19 livestock shall be exempt from the provisions of the Oklahoma Milk
19
20 and Milk Products Act.
20
21 B. 1. Ungraded raw milk or raw milk products sold pursuant to
21
22 this section shall be produced by the livestock maintained on the
22
23 premises from which the ungraded raw milk or raw milk products are
23
24 advertised for sale.

1 2. Ungraded raw milk or raw milk products may be transported

2 off the premises from which the ungraded raw milk or raw milk
2
3 products are produced for sale at a farmers market or by a third-
3
4 party vendor to a consumer.

5 C. Any farmer or producer selling, offering, or exposing for
5
6 sale raw milk or raw milk products pursuant to subsection B of this
6
7 section shall label the container to indicate to the consumer that
7
8 the product is raw or unpasteurized milk and the date the milk was
8
9 filled, and disclose if the product is not licensed, regulated, or
9
10 inspected prior to delivery.

11 SECTION 3. REPEALER 2 O.S. 2021, Section 7-417, is
11
12 hereby repealed.

13 SECTION 4. It being immediately necessary for the preservation
13
14 of the public peace, health or safety, an emergency is hereby
14
15 declared to exist, by reason whereof this act shall take effect and
15
16 be in full force from and after its passage and approval.
