7   An Act relating to transportation; amending Section

7   1, Chapter 490, O.S.L. 2025 (69 O.S. Supp. 2025,

8   Section 508), which relates to the Preserving and

8   Advancing County Transportation Fund; providing

9   certain factors for distribution of certain funds;

9   updating statutory language; updating statutory

10  references; providing an effective date; and

10  declaring an emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
13

14  SECTION 1.      AMENDATORY  Section 1, Chapter 490, O.S.L.

14

15 2025 (69 O.S. Supp. 2025, Section 508), is amended to read as
15

16 follows:
16

17  Section 508. A. There is hereby created in the State Treasury

17

18 a revolving fund to be designated as the "Preserving and Advancing
18

19 County Transportation Fund" (PACT Fund). The fund shall be a
19

20 continuing fund, not subject to fiscal year limitations, and shall
20

21 consist of all monies directed for deposit to the fund by law
21

22 including, but not limited to, apportionments made pursuant to
22

23 paragraph 10 11 of subsection B of Section 1004 of Title 68 of the
23

24 Oklahoma Statutes. All monies accruing to the credit of said the

1 fund are hereby appropriated and may be allocated, budgeted, and
1

2 expended pursuant to subsection B of this section. Expenditures
2

3 from said the fund shall be made upon warrants issued by the State
3

4 Treasurer against claims filed as prescribed by law with the
4

5 Director of the Office of Management and Enterprise Services for
5

6 approval and payment.

7   B. 1. Two-thirds (2/3) of the monies deposited to the credit

7

8 of the PACT Fund shall be allocated as follows:
8

9   a. to the various counties in a manner that increases

9

10                 accounts for a county's population, traffic volume,

10

11                 military-related impacts, lane-mile burdens, presence

11

12                 of major federal installations, and per county mile

12

13                 highway construction and maintenance ratio, with the

13

14                 goal of increasing such ratio to a target ratio of

14

15                 Four Thousand Dollars ($4,000.00) per county road

15

16                 mile, prioritizing counties impacted most by the

16

17                 factors provided for in this subparagraph and with the

17

18                 lowest such ratio, until all of the various counties

18

19                 reach such target ratio, and

19

20  b. any remaining amounts as follows:

21                 (1) fifty percent (50%) shall be allocated to the

21

22                 various counties in the proportion which the

22

23                 certified county road miles of each county bears

23

24                 to the sum of county road miles in the state, and

1                  (2) fifty percent (50%) shall be allocated to the

2                  various counties in the proportion which the

2

3                  number of county bridges in each county according

3

4                  to the most recent ODOT Department of

4

5                  Transportation Bridge Summary Report for County

5

6                  Bridges bears to the total sum of county bridges

6

7                  in the state according to such report.

7

8   Each county treasurer shall deposit such funds to the county's

8

9 county highway fund and such funds shall be used for constructing
9

10 and maintaining the county highway system.

11  2. One-third (1/3) of the monies deposited to the credit of the

11

12 PACT Fund shall be used as necessary for the reconstruction of
12

13 county bridges on the portion of the county highway system defined
13

14 as major collector routes in accordance with the provisions of
14

15 Section 654 of Title 69 of the Oklahoma Statutes this title. Prior
15

16 to any funds for such projects being allocated, the counties shall
16

17 submit the proposed projects to the Department of Transportation,
17

18 which shall evaluate and confirm whether the proposed projects are
18

19 in accordance with the criteria provided for in this subsection.
19

20 Bridges proposed for reconstruction will be generally evaluated
20

21 based on the state of project innovation, readiness, structural
21

22 adequacy, safety, serviceability, functional obsolescence,
22

23 essentiality for public use, structural deficiency ranking as
23

24 captured in the most recent ODOT Department of Transportation Bridge

1 Summary Report at the time of submission, and special reductions for
1

2 characteristics such as detour length, traffic safety features, and
2

3 current school bus routes. Upon confirmation by the Department of
3

4 Transportation that a proposed project is in accordance with the
4

5 criteria provided for in this subsection, funds shall be allocated
5

6 to the county for use in such project.

7   SECTION 2. This act shall become effective July 1, 2026.

7

8   SECTION 3. It being immediately necessary for the preservation

8

9 of the public peace, health or safety, an emergency is hereby
9

10 declared to exist, by reason whereof this act shall take effect and
10

11 be in full force from and after its passage and approval.
