7 An Act relating to agriculture; amending 2 O.S. 2021,
7 Section 10-78, which relates to the sale of eggs;
8 allowing for sale of certain eggs in specified
8 locations; establishing limit on sale of ungraded
9 eggs; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 2 O.S. 2021, Section 10-78, is
13
14 amended to read as follows:

15 Section 10-78. A. Oklahoma producers of eggs selling ungraded
15
16 eggs from their own flock production are exempt from this
16
17 subarticle. Nothing in this subarticle shall prohibit the sale of
17
18 eggs produced on the farm and sold direct to the consumer on the
18
19 farm, at a farmers' market, or otherwise off the farm direct to the
19
20 consumer. Eggs sold under this section shall be produced by hens
20
21 maintained on the farm from which the eggs are sold.

22 B. To be eligible to sell ungraded eggs pursuant to the
22
23 provisions of subsection A of this section, an egg producer in this
23

1 state shall be limited to the sale of no more than one hundred fifty

2 (150) eggs per month.

3 C. A producer may sell graded eggs if in compliance with this
3
4 subarticle.

5 SECTION 2. This act shall become effective November 1, 2026.
