7   An Act relating to the Oklahoma Milk and Milk

7   Products Act; amending 2 O.S. 2021, Section 7-414,

8   which relates to construction of the Oklahoma Milk

8   and Milk Products Act; exempting certain sales;

9   authorizing the sale of ungraded raw milk; allowing

9   for off-premises sale upon registration for certain

10  sales with the Oklahoma Department of Agriculture,

10  Food, and Forestry; requiring certain notification

11  upon sale; providing for promulgation of rules;

11  providing for codification; and providing an

12  effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.         AMENDATORY  2 O.S. 2021, Section 7-414, is

15

16 amended to read as follows:
16

17  Section 7-414. A. The provisions of the Oklahoma Milk and Milk

17

18 Products Act shall not be construed to:
18

19  1. Include incidental sales of ungraded raw milk directly to

19

20 consumers:
20

21  a. at the farm where the ungraded raw milk is produced,

21

22                 or

22

23  b. by transport by the farmer of the ungraded raw milk

23

24                 pursuant to subsection C of Section 2 of this act;

1     2. Preclude the advertising of the incidental sale of goat

1

2 milk; and
2

3     3. Preclude the advertising of the sale of ungraded raw milk;

3

4 or
4

5     4. Prohibit any farmer or producer from making cheese using

5

6 milk or cream produced on the farm of such farmer or producer.
6

7     B. For purposes of this section, incidental sales of goat milk

7

8 are those sales where the average monthly number of gallons sold
8

9 does not exceed one hundred (100) three hundred (300).
9

10    SECTION 2.   NEW LAW  A new section of law to be codified

10

11 in the Oklahoma Statutes as Section 7-422 of Title 2, unless there
11

12 is created a duplication in numbering, reads as follows:
12

13    A. Any farmer selling, offering, or exposing for sale ungraded

13

14 raw milk from his or her livestock is exempt from the provisions of
14

15 the Oklahoma Milk and Milk Products Act.
15

16    B. Ungraded raw milk sold pursuant to this section shall be

16

17 produced by the livestock maintained on the premises from which the
17

18 ungraded raw milk is advertised for sale.
18

19    C. For ungraded raw milk transported off the premises from

19

20 which the ungraded raw milk is produced for sale at a farmers
20

21 market, the farm shall be registered with the Oklahoma Department of
21

22 Agriculture, Food, and Forestry.
22

23    D. Any farm selling, offering, or exposing for sale ungraded

23

24 raw milk pursuant to subsection C of this section shall notify the

1 consumer that the product is not licensed, regulated, or inspected
1

2 prior to delivery.

3   E. The State Board of Agriculture shall promulgate all rules

3

4 necessary for the implementation of this section.
4

5   SECTION 3. This act shall become effective November 1, 2026.
