7 An Act relating to game and fish; defining terms;
7 allowing the possession of captive-bred alligators
8 without a permit; prohibiting the possession of
8 native-bred alligators; authorizing promulgation of
9 rules by the Department of Wildlife Conservation;
9 creating misdemeanor offenses; providing penalties;
10 providing for codification; and providing an
10 effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 7-502.1 of Title 29, unless
15
16 there is created a duplication in numbering, reads as follows:

17 A. As used in this section:
17
18 1. "Captive-bred alligator" means any alligator hatched from
18
19 eggs in captivity; and
19
20 2. "Native-bred alligator" means any alligator of a species
20
21 indigenous to this state that has been hatched from eggs in the
21
22 wild.

1 B. Except as otherwise provided by law, no permit shall be
1
2 required to possess a captive-bred alligator that has been verified
2
3 as captive-bred under the provisions of this section.
3
4 C. No person shall take or possess a native-bred alligator, or
4
5 the eggs of a native-bred alligator, for the purpose of declaring
5
6 the alligator as captive-bred, whether for private ownership, sale,
6
7 or transfer.

8 D. The Department of Wildlife Conservation shall promulgate
8
9 rules necessary to implement and administer the provisions of this
9
10 section.

11 E. Any person convicted of violating any provision of this
11
12 section shall, upon conviction, be guilty of a misdemeanor
12
13 punishable by a fine not less than One Hundred Dollars ($100.00) nor
13
14 more than Five Hundred Dollars ($500.00), by imprisonment in the
14
15 county jail not to exceed thirty (30) days, or by both such fine and
15
16 imprisonment.

17 SECTION 2. This act shall become effective November 1, 2026.
