7 An Act relating to transportation; requiring the
7 Department of Transportation to submit certain
8 notification to the Attorney General; requiring
8 Department to receive certain approval before taking
9 certain action; providing for codification; and
9 providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 1105 of Title 69, unless there
15
16 is created a duplication in numbering, reads as follows:

17 The Department of Transportation shall, prior to making a claim
17
18 against a surety company for financial loss due to the
18
19 nonperformance of a contractor engaged in contract with the
19
20 Department, notify the Attorney General of its intent to make such
20
21 claim. The Attorney General shall review the information submitted
21
22 by the Department and approve or disapprove the making of such
22
23 claim. The Department shall only proceed with making such claim if
23
24 the Attorney General approves of such.

1 SECTION 2. This act shall become effective November 1, 2026.
