7 An Act relating to education; amending 70 O.S. 2021,
7 Section 3-116.2, which relates to the Commission for
8 Educational Quality and Accountability; directing the
8 terms of certain members to be staggered upon certain
9 date; directing terms of members to be in accordance
9 with certain designations; amending 70 O.S. 2021,
10 Section 3-116.5, which relates to Commission
10 reporting requirements; directing certain report to
11 be electronically submitted with certain frequency;
11 allowing the Commission to use certain funds to
12 perform its duties; amending 70 O.S. 2021, Section 6-
12 211, which relates to the educator supply-and-demand
13 study; directing the Commission, rather than the
13 State Board of Education, to conduct the study in
14 certain cooperation; amending 70 O.S. 2021, Section
14 1210.531, which relates to the Oklahoma Educational
15 Indicators Program; directing the Commission to
15 include certain data in certain program; directing
16 the Commission to be provided certain data within
16 certain time period; directing the State Board of
17 Education to ensure certain contracts include certain
17 requirement; allowing the Commission to contract with
18 an independent third party to receive, process, and
18 report certain data; updating statutory references;
19 updating statutory language; and providing an
19 effective date.

23 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

1 SECTION 1. AMENDATORY 70 O.S. 2021, Section 3-116.2, is
1
2 amended to read as follows:
2
3 Section 3-116.2. A. Effective January 1, 2013, there is hereby
3
4 created the Commission for Educational Quality and Accountability.
4
5 The membership of the Commission shall consist of:
5
6 1. The Secretary of Education, who shall serve as the chair of
6
7 the Commission;
7
8 2. One member appointed by the Governor, with the advice and
8
9 consent of the Senate, representing business and industry from an
9
10 Oklahoma employer with five hundred (500) or fewer employees;
10
11 3. One member, appointed by the Governor, with the advice and
11
12 consent of the Senate, who is a parent of a child enrolled in a
12
13 public school in this state;
13
14 4. One member, appointed by the Governor, with the advice and
14
15 consent of the Senate, who is an administrator of a public school
15
16 district;
16
17 5. One member, appointed by the Governor, with the advice and
17
18 consent of the Senate, who shall represent higher education teacher
18
19 education programs;
19
20 6. One member appointed by the Governor, with the advice and
20
21 consent of the Senate, who shall be an active classroom teacher in
21
22 kindergarten through grade six; and

1 7. One member appointed by the Governor, with the advice and

2 consent of the Senate, who shall be an active classroom teacher in
2
3 grades seven through twelve.
3
4 Upon the effective date of this act, the terms of the six
4
5 appointed members shall be staggered such that the terms of no more
5
6 than two members end in the same year. The terms of the initial
6
7 appointed members shall commence on January 1, 2013 July 1, 2028,
7
8 and shall end on June 30, 2014 in accordance with designations by
8
9 the Governor, with the Governor designating two members whose terms
9
10 shall end on June 30, 2030, two members whose terms shall end on
10
11 June 30, 2031, and two members whose terms shall end on June 30,
11
12 2032. The Thereafter, the Governor shall appoint two members at a
12
13 time, and the terms of subsequently appointed members shall commence
13
14 on July 1 of each year following the election of the Governor
14
15 thereafter and shall be for four (4) years. If a vacancy occurs,
15
16 the vacancy shall be filled for the unexpired term in the same
16
17 manner as the office was previously filled.
17
18 B. A quorum of the Commission, which shall consist of four
18
19 members, shall be present in order for the Commission to transact
19
20 any business. Members shall be reimbursed for travel in the
20
21 performance of their official duties in accordance with the State
21
22 Travel Reimbursement Act.
22
23 C. Prior to July 1, 2013, the Commission shall meet to organize
23
24 and plan for the assumption of the powers and duties of the

1 Education Oversight Board and the Oklahoma Commission for Teacher

2 Preparation.

3 D. Beginning July 1, 2013, the Commission shall assume the
3
4 following duties:
4
5 1. Oversee implementation of the provisions of Enrolled House
5
6 Bill No. 1017 of the 1st Extraordinary Session of the 42nd Oklahoma
6
7 Legislature;
7
8 2. Implementation of the provisions of the Oklahoma Teacher
8
9 Preparation Act as provided for in law;
9
10 3. Make recommendations to the Governor and Legislature on
10
11 methods to achieve an aligned, seamless system from preschool
11
12 through postsecondary education; and
12
13 4. Set performance levels and corresponding cut scores pursuant
13
14 to the Oklahoma School Testing Program Act and as provided for in
14
15 Section 1210.541 of Title 70 of the Oklahoma Statutes this title.
15
16 E. Beginning July 1, 2013, the Commission shall govern the
16
17 operation of the Office of Educational Quality and Accountability
17
18 created in Section 3-117 of Title 70 of the Oklahoma Statutes this
18
19 title.
19
20 F. 1. Beginning July 1, 2014, the Commission shall assume the
20
21 following duties of the Oklahoma Commission for Teacher Preparation
21
22 according to the provisions of the Oklahoma Teacher Preparation Act:
22
23 a. approval and accreditation of teacher education
23
24 programs, and

1 b. assessment of candidates for licensure and
1
2 certification.

3 2. To implement the provisions of this subsection the
3
4 Commission shall:
4
5 a. include the State Board of Education in the process,
5
6 b. review and assess approved, accredited, and new
6
7 programs of teacher education, and
7
8 c. encourage studies and research designed to improve
8
9 teacher education.
9
10 SECTION 2. AMENDATORY 70 O.S. 2021, Section 3-116.5, is
10
11 amended to read as follows:
11
12 Section 3-116.5. A. On or before October 31, 2021 November 1,
12
13 2027, and every three (3) years thereafter, the Commission for
13
14 Educational Quality and Accountability shall issue electronically
14
15 submit a report to the Speaker of the Oklahoma House of
15
16 Representatives, the President Pro Tempore of the Oklahoma State
16
17 Senate, and the Governor detailing factors in the public education
17
18 system of the state that contribute to improvements in the:
18
19 1. Common education system, including, but not limited to, high
19
20 school graduation rates and college and career assessment scores;
20
21 2. Higher education and career and technology education
21
22 systems, including, but not limited to, timely graduation rates and
22
23 reduced remediation rates; and

1 3. State workforce, including, but not limited to, career
1
2 readiness and the ability for new graduates to find in-state
2
3 employment.

4 B. If the Commission finds there is insufficient information
4
5 available to fulfill any of the report objectives specified in
5
6 subsection A of this section, the report shall also contain
6
7 recommendations on ways to address information gaps between state
7
8 entities, such as the State Department of Education, the Oklahoma
8
9 Department of Career and Technology Education, and the Oklahoma
9
10 State Regents for Higher Education.
10
11 C. The Commission may contract with a private consultant or
11
12 consultants to assist with the development of the report.
12
13 D. The Commission may utilize any funds received including, but
13
14 not limited to, any state or federal funds, grants, or private
14
15 donations to assist with the development of the report or to assist
15
16 the Commission with its general purposes or duties prescribed by
16
17 statute.
17
18 SECTION 3. AMENDATORY 70 O.S. 2021, Section 6-211, is
18
19 amended to read as follows:
19
20 Section 6-211. The Commission for Educational Quality and
20
21 Accountability, in cooperation with the State Board of Education in
21
22 cooperation with the Commission for Educational Quality and
22
23 Accountability, the Oklahoma State Regents for Higher Education, and
23
24 institutions of higher education shall conduct an educator supply-

1 and-demand study every three (3) years. The study shall identify
1
2 areas of teacher shortage and make recommendations for addressing
2
3 the areas of most critical need. The Board Commission shall
3
4 electronically submit a report outlining the findings to the
4
5 Governor, the Speaker of the House of Representatives, and the
5
6 President Pro Tempore of the Senate.
6
7 SECTION 4. AMENDATORY 70 O.S. 2021, Section 1210.531, is
7
8 amended to read as follows:
8
9 Section 1210.531. A. The Commission for Educational Quality
9
10 and Accountability shall establish an Oklahoma Educational
10
11 Indicators Program. The purpose of the Program shall be to develop
11
12 and implement a system of measures whereby the performance of public
12
13 schools and school districts is assessed and reported without undue
13
14 reliance upon any single type of indicator, and whereby the public,
14
15 including students and parents, may be made aware of the proper
15
16 meaning and use of any tests administered under the Oklahoma School
16
17 Testing Program Act, relative accomplishments of the public schools,
17
18 and of progress being achieved. The Commission shall involve
18
19 representatives of school teachers and of school administrators in
19
20 the development of the Program. The Program shall be so designed
20
21 that use of standardized definitions and measures and opportunities
21
22 for coordination with national reports, including those of the
22
23 National Assessment of Educational Progress, are maximized.

1 B. The Oklahoma Educational Indicators Program shall present
1
2 information for comparisons of graduation rates, dropout rates,
2
3 pupil-teacher ratios, student enrollment gain and loss rates, and
3
4 test results in the contexts of socioeconomic status and the
4
5 finances of school districts. Information shall be provided
5
6 individually for all public school sites and school districts in a
6
7 format that facilitates comparisons. As necessary data become
7
8 available, comparisons shall also be provided individually for all
8
9 schools and school districts on a historical basis. Reports of all
9
10 tests administered pursuant to the Oklahoma School Testing Program
10
11 Act shall be a part of the Oklahoma Educational Indicators Program
11
12 and shall be provided for each grade and each test subject or set of
12
13 competencies. Test results for students enrolled in Internet-based
13
14 courses, including regularly enrolled and alternative education
14
15 students, shall be disaggregated and reported. The Commission for
15
16 Educational Quality and Accountability shall seek to develop and
16
17 incorporate additional indicators of comparative standing and
17
18 accomplishment.
18
19 C. Additionally, the Commission for Educational Quality and
19
20 Accountability, with the cooperation of the State Department of
20
21 Education, the Oklahoma State Regents for Higher Education, and the
21
22 State Board of Career and Technology Education, shall develop
22
23 procedures for obtaining and reporting data to the high schools and
23
24 to the general public regarding the performance of each high

1 school's graduates in Oklahoma's institutions of higher education in
1
2 this state and in postsecondary vocational-technical education. The
2
3 Commission shall include workforce outcomes of high school graduates
3
4 including postsecondary enrollment, credential attainment,
4
5 employment, and earnings information as such data becomes available.
5
6 The Commission for Educational Quality and Accountability shall
6
7 include such data in the report of the Oklahoma Educational
7
8 Indicators Program.
8
9 D. By February 1 of each year the Commission for Educational
9
10 Quality and Accountability shall publish:
10
11 1. A summary report to the people and the Legislature of
11
12 Oklahoma of the information provided by the Oklahoma Educational
12
13 Indicators Program; and
13
14 2. State State-, district district-, and site level site-level
14
15 reports which shall include the percentage of students who perform
15
16 at the various levels on the tests required by the Oklahoma State
16
17 Testing Program.
17
18 Immediately following the publication of the reports required in
18
19 this subsection each year, all data gathered pursuant to the
19
20 Oklahoma Educational Indicators Program shall be made available for
20
21 public inspection at the Office of Educational Quality and
21
22 Accountability. The confidentiality of individual student records
22
23 shall be preserved as required by law.

1 E. In order to carry out the provisions of this section, the
1
2 Commission for Educational Quality and Accountability shall be
2
3 provided all data and reports necessary to develop and produce the
3
4 Oklahoma Educational Indicators Program reports within thirty (30)
4
5 days of the necessary data becoming available. Such data shall be
5
6 provided directly to the Commission by the State Department of
6
7 Education, the Oklahoma State Regents for Higher Education, the
7
8 State Board of Career and Technology Education, the Office of
8
9 Management and Enterprise Services, the Oklahoma Employment Security
9
10 Commission, and any state contractor or assessment vendor that
10
11 maintains or produces necessary data.
11
12 F. 1. The State Board of Education shall ensure that any
12
13 contracts with assessment vendors include a requirement that the
13
14 vendor transmit assessment results and related data files necessary
14
15 for the Oklahoma Educational Indicators Program directly to the
15
16 Commission for Educational Quality and Accountability at the same
16
17 time such results are transmitted to the State Department of
17
18 Education.
18
19 2. Data required by this subsection shall be provided to the
19
20 Commission without the need for a separate data-sharing agreement
20
21 with related state agencies and shall be subject to the Oklahoma
21
22 Open Records Act; provided, however, that the confidentiality of
22
23 individual student records shall be preserved as required by state
23
24 and federal law.

1 3. The Commission may contract with an independent third party
1
2 to receive, process, and report data submitted pursuant to this
2
3 subsection and may receive and expend federal or private grant funds
3
4 to carry out its duties pursuant to this section.
4
5 SECTION 5. This act shall become effective November 1, 2026.
