9   An Act relating to contracts; creating the Predatory

9   Solicitation Prevention Act; providing short title;

10  defining term; prohibiting certain practice;

10  providing for fines and fees; directing deposit of

11  fine or fee to certain funds; providing for

11  noncodification; providing for codification; and

12  providing an effective date.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

17  SECTION 1.      NEW LAW       A new section of law not to be

17

18 codified in the Oklahoma Statutes reads as follows:
18

19  This act shall be known and may be cited as the "Predatory

19

20 Solicitation Prevention Act".
20

21  SECTION 2.      NEW LAW       A new section of law to be codified

21

22 in the Oklahoma Statutes as Section 1030 of Title 15, unless there
22

23 is created a duplication in numbering, reads as follows:

1   A. As used in this act, "predatory solicitation" means

1

2 persistent, repeated communication to solicit a purchase, sale, or
2

3 investment in real property and such communication is designed to
3

4 influence, harass, intimidate, aggravate, badger, or otherwise not
4

5 accept the property owner's ability to refuse.
5

6        B. No person or entity shall engage in the practice of

6

7 predatory solicitation in this state.
7

8        C. Any person or entity that engages in the practice of

8

9 predatory solicitation in this state shall be liable for a penalty
9

10 in the amount of Six Hundred Dollars ($600.00) per instance of
10

11 communication.

12  SECTION 3.     NEW LAW  A new section of law to be codified

12

13 in the Oklahoma Statutes as Section 1031 of Title 15, unless there
13

14 is created a duplication in numbering, reads as follows:
14

15  A. The Attorney General or a district attorney may bring an

15

16 action to recover actual damages and penalties as provided by this
16

17 act.
17

18  B. Of the monies collected under this act through an action of

18

19 the Attorney General:
19

20  1. Fifty percent (50%) shall be credited to the State Health

20

21 Care Enhancement Fund, created pursuant to Section 302-7a of Title
21

22 68 of the Oklahoma Statutes; and

1   2. Fifty percent (50%) shall be credited to the Court Clerk's

2 Revolving Fund, created pursuant to Section 220 of Title 19 of the
2

3 Oklahoma Statutes.

4   SECTION 4. This act shall become effective November 1, 2026.
