7 An Act relating to the state Medicaid program;
7 requiring the Oklahoma Health Care Authority to
8 provide certain reimbursement to hospitals under
8 specified conditions; directing the Authority to seek
9 certain federal approval; providing for codification;
9 providing an effective date; and declaring an
10 emergency.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 5025.1 of Title 63, unless there
15
16 is created a duplication in numbering, reads as follows:

17 A. The Oklahoma Health Care Authority shall provide Medicaid
17
18 reimbursement to a hospital at one hundred percent (100%) of the
18
19 statewide average nursing facility per diem rate for an individual
19
20 if the individual:
20
21 1. Is enrolled in the state Medicaid program;
21
22 2. Has been admitted as an inpatient to such hospital;
22
23 3. No longer requires acute inpatient care and discharge
23
24 planning as described in 42 C.F.R., Section 482.43;

1 4. Requires nursing facility level of care upon discharge; and

2 5. Is unable to be transferred to a nursing facility due to a
2
3 lack of nursing facility beds available to the individual or, in
3
4 cases where the transfer requires a guardian, because the court has
4
5 not appointed a guardian.

6 B. Reimbursement for services under this section shall be
6
7 subject to federal approval. The Authority shall seek any federal
7
8 approval necessary to implement the provisions of this section.
8
9 SECTION 2. This act shall become effective July 1, 2025.
9
10 SECTION 3. It being immediately necessary for the preservation
10
11 of the public peace, health or safety, an emergency is hereby
11
12 declared to exist, by reason whereof this act shall take effect and
12
13 be in full force from and after its passage and approval.
