7 An Act relating to agriculture; amending 2 O.S. 2021,
7 Section 7-414, which relates to the Oklahoma Milk and
8 Milk Products Act; specifying types of sales;
8 exempting the advertisements of certain sales;
9 increasing average monthly yield for incidental
9 sales; and declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 2 O.S. 2021, Section 7-414, is
13
14 amended to read as follows:

15 Section 7-414. A. The provisions of the Oklahoma Milk and Milk
15
16 Products Act shall not be construed to:
16
17 1. Include incidental sales of ungraded raw milk or raw milk
17
18 products directly to consumers at the farm where the ungraded raw
18
19 milk is or raw milk products are produced;
19
20 2. Preclude the advertising of the incidental sale of goat
20
21 milk; and
21
22 3. Preclude the advertising of the sale of ungraded raw milk or
22
23 raw milk products; and

1 4. Prohibit any farmer or producer from making cheese using

2 milk or cream produced on the farm of such farmer or producer.

3 B. For purposes of this section, incidental sales of goat milk
3
4 and milk products are those sales where the average monthly number
4
5 of gallons sold does not exceed one hundred (100) one thousand five
5
6 (1,500).

7 SECTION 2. It being immediately necessary for the preservation
7
8 of the public peace, health or safety, an emergency is hereby
8
9 declared to exist, by reason whereof this act shall take effect and
9
10 be in full force from and after its passage and approval.
